Conclusion of Section 106 Consultation for Proposed License Renewal Richland County, South Carolina SHPO Project No. 15-EJ0022 Docket Number: 70-1151
Dear Jesse Muir-Quintero:
Thank you for your letter of May 26, 2022 which we have received electronically and in hard copy regarding the above-referenced consultation. We have also received the final copies of the cultural resources survey report, GIS shapefiles and survey forms/photographs. The State Historic Preservation Office (SHPO) is providing comments for the U.S. Nuclear Regulatory Commission (NRC) pursuant to Section 106 of the National Historic Preservation Act and its implementing regulations, 36 CFR 800. Consultation with the SHPO is not a substitution for consultation with Tribal Historic Preservation Offices, other Native American tribes including those with state recognition, local governments, or the public.
The NRC is considering a request to renew the operating license for the CFFF for an additional 40 years. The NRC has prepared an Environmental Impact Statement (EIS) that provides the NRC staffs analyses of potential impacts to historic properties. NRC coordinated Section 106 review with the National Environmental Policy Act (NEPA) environmental review.
Based on the information including the cultural resources survey of the CFFF conducted by Brockington and Associates, and the updated cultural resource protection and management procedures (March 2022) the NRC has determined that the proposed license renewal will not affect historic properties as defined in the Section 106 regulations. Based on the information provided, our office would concur with this determination.
We continue to request that:
Westinghouse compile the information related to cultural resources at the CFFF in one binder/folder (it may be digital) including the cultural resources survey, maps, and the referenced cultural resources protocols along with contact information for appropriate staff at NRC, SHPO, and Westinghouse. This collected information should be provided to our office, and any other consulting parties, and updated as appropriate, to ensure that each entity has current cultural resources documentation and contact information readily accessible.
Our office, other consulting parties and the NRC be provided with annual updates by Westinghouse indicating whether or not any cultural resources work has been undertaken in the previous year or is planned at the site. This annual update, which could take the form of a memo or letter, should also include a status update for the Denley Cemetery.
