OF THE MARCH 17, 2022, PUBLIC MEETING ON THE FISCAL YEAR 2022 PROPOSED FEE RULE On March 17, 2022, the U.S. Nuclear Regulatory Commission (NRC) held an information meeting with a question-and-answer session with industry stakeholders and members of the public to discuss the Fiscal Year (FY) 2022 Proposed Fee Rule, which was published in the Federal Register on February 23, 2022, for a 30-day comment period ending on March 25, 2022. The NRC staff posted the meeting notice and agenda in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML2207A355, and the presentation slides at ADAMS Accession No. ML22075A326. Enclosure 1 lists the meeting attendees who participated remotely, and Enclosure 2 provides the official transcript of the meeting.

The meeting began with a review of the ground rules, followed by opening remarks by Cherish Johnson, the Chief Financial Officer, who gave an introduction of the NRC staff from the Office of Chief Financial Officer (OCFO) and the Office of Nuclear Reactor Regulation (NRR) who were on the panel. The meeting included a dedicated time to answer questions from members of the public. During the meeting, NRC staff presented key features of the FY 2022 Proposed Fee Rule with a discussion about how fees were related to the budget. NRC staff in NRR discussed the Reactor Safety Program, which is comprised of the Operating and New Reactors Business Lines, specifically the major activities that are performed, the assumptions used in the development of the budget (e.g., workload forecasting, estimated level of effort, type of work, and historical resource utilization), and the changing workload drivers that impacted the FY 2022 budget.

During the designated question and answer portion of the meeting, the questions primarily were focused on the following areas:

1) Budget formulation and execution: carryover funding, including, but not limited to, Congressional direction to use of authorized carryover funding, the amount of carryover funding available, excluding certain items from fee recovery as excluded activities, and the NRCs ability to use carryover funding to reduce fees.
2) Non-power production or utilization facilities (NPUF) fee class: the increase in annual fees due to the decrease in the number of operating NPUFs from four to three, the changes in the budget, and that the assessment of annual fees for this fee class is in contravention of Section 104c of the Atomic Energy Act, as amended, and 10 CFR 50.41(b).
3) Operating power reactors fee class: How the NRC accounts for differences between what is used in formulation of the budget and what actually occurs due to schedule changes for Vogtle Unit 3 and the announced closure of Palisades. In addition, there were questions regarding the final fee rule projections for 10 CFR Part 170 estimated billings.
4) Process Comments: The NRC should hold the fee rule public meeting earlier and discuss the annual fees for other fee classes during future meetings.
