Proprietary Review: NAC International, Inc., Submission of Responses to the Nuclear Regulatory Commission"s (NRC) Request for Additional Information for the Request to Renew the NAC-UMS Cask System Certificate of Compliance No. 1015 Date: Monday, March 21, 2022 8:45:00 AM Attachments: image003.png image004.png image005.png image006.png image007.png image008.png image009.png Mr. Fowler, By letter dated October 13, 2020, (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20293A102), NAC International (NAC) submitted an application for renewal of Certificate of Compliance (CoC) No. 1015 for the NAC Universal Multipurpose Systems (NAC-UMS). By letter dated December 21, 2021 (ADAMS Accession No. ML21334A509), the NRC transmitted a request for additional information (RAI). By letter dated March 3, 2022 (ADAMS Accession No. ML22062A762), NAC submitted a response to the NRCs RAI. NACs response included an affidavit from George Carver dated March 3, 2022, executed by Heath M. Baldner, Notary Public in the State of Georgia. You requested that the following documents be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Part 2, Section 2.390:

Enclosure 3, Appendix B, 30013-2001, Fatigue Evaluation of MPC and UMS Storage System Components for Extended Storage, Rev. 2 We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.390 and, on the basis of your statement, have determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure. Further, these documents may be withheld in whole because the submitted response also contains public versions of these documents with the proprietary materials redacted.

Therefore, Enclosure 3, Appendix B, 30013-2001, Fatigue Evaluation of MPC and UMS Storage System Components for Extended Storage, Rev. 2 will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified of the date of public disclosure, in advance which will be a reasonable time thereafter.
