OF THE FEBRUARY 17, 2022, PUBLIC MEETING WEBINAR BETWEEN THE U.S. NUCLEAR REGUALTORY COMMISSION, NUCLEAR ENERGY INSTITUTE, AND NUCLEAR INDUSTRY RELATED TO EXTREME ENVIRONMENTAL PHENOMENA DURING INDEPENDENT SPENT FUEL STORAGE INSTALLATION OPERATIONS On February 17, 2022, the U.S. Nuclear Regulatory Commission (NRC) staff conducted a public meeting webinar with representatives from the Nuclear Energy Institute (NEI), nuclear industry, and members of the public. The purpose of this webinar was to summarize the staffs review of extreme environmental phenomena (EEP) related to tornado hazards during dry cask storage loading campaigns and discuss a proposed new guideline to use administrative controls. The webinar also provided the NRC staff an opportunity to reiterate the regulatory requirements associated with tornado hazards and discuss recommendations for a path forward. The public meeting notice and agenda topics are available in the Agencywide Documents Access and Management System (ADAMS) under Accession No. ML22048C215. The NEI presentation and guidance document are available in ADAMS under Accession Nos. ML22047A128 and ML22047A142, respectively. The enclosure to this document contains the meeting attendance list. C. Regan 2 Discussion The webinar was an open exchange of information with approximately 138 participants including the NRC staff. On February 16, 2022, (ADAMS Accession No. ML22048A581), NEI submitted to NRC NEI 22-02, Guidelines for Weather-Related Administrative Controls for Short Duration Outdoor Dry Cask Storage Operations, for NRC review and endorsement. NEI developed the guidance document following discussions held on November 9, 2021 (ADAMS Accession No. ML21342A221), public meeting between NRC and nuclear industry on approaches to addressing tornado hazards during ISFSI operations. During the public meeting the NRC staff asked clarifying questions and provided perspectives. NEIs presentation focused on the NEI 22-02 proposed guidance which will provide the supporting information for site-specific measures that should be implemented by licensees to address the potential for severe weather during dry storage system campaign. Also, it provides resources and implementation guidance to help the licensees develop appropriate and consistent site-specific administrative controls that cannot be generically specified.

During the meeting the NRC staff provided an overview of the very low safety significance issue resolution (VLSSIR) process and discussed the regulatory requirements and licensing basis associated with tornado hazards. The NRC staff described how the determination of the safety significance is ongoing due to unique circumstances at each site and provided insights to the decision-making process regarding the potential regulatory pathway to resolve the issue.

The public meeting also provided members of the public an opportunity to ask questions and provide comments to the NRC staff. The NRC staff did not receive any comments from the public.

Action Items/Next Steps The NRC staff will consider applying the VLSSIR process where appropriate. However, the NRC wants to ensure that licensees have clarity on the regulatory issue and that this issue is addressed appropriately commensurate with its safety significance, as industry proceeds with dry cask storage loading campaigns. The NRC staff plans to review NEI 22-02 guidance document and communicate any schedules on tornado hazards evaluations to facilitate a common understanding between industry and NRC.
