Good morning Ms. Leek, By letter dated June 28, 2021 (ADAMS Accession No. ML21179A286), as supplemented by letter dated December 16, 2021 (ADAMS Accession No. ML21350A097), NextEra Energy Duane Arnold submitted an amendment request consisting of changes to the Duane Arnold Energy Center (DAEC) emergency plan.

The proposed changes would revise the DAEC Emergency Plan to reflect the requirements associated with emergency preparedness necessary for the independent spent fuel storage installation (ISFSI) only configuration, consistent with the permanent removal of all spent fuel from the DAEC spent fuel pool.

Specifically, the proposed changes would implement a revision to the Emergency Plan and an associated Emergency Action Level scheme to implement an ISFSI Only Emergency Plan (IOEP), which will reflect the movement of all spent fuel into dry storage within the onsite ISFSI; an action that is scheduled to occur by mid-2022.

The Commission issued proposed finding that the amendment application involves no significant hazards consideration published in the Federal Register (FR) on September 7, 2021 (86 FR 50190). I've attached a copy of this notice for reference. The supplemental letter from the licensee dated December 16, 2021, provided additional information that clarified the application, but did not expand the scope of the application as originally noticed, or change the NRC's original proposed no significant hazards consideration determination published on September 7, 2021. Additionally, we believe a categorical exclusion would apply

pursuant to 10 CFR 51.22(b).

We are considering finalizing this determination. If the State of Iowa has comments on this license amendment request or our proposed no significant hazards determination, please email me your comments by March 28, 2022. If you do not have comments, I would appreciate an email confirming this by the same date.
