UPDATED STAFF RESPONSE TO ACRS LETTER, DATED JULY 26, 2021, IN REGARD TO PROPOSED REVISION 5 TO REGULATORY GUIDE 1.9, APPLICATION AND TESTING OF ONSITE EMERGENCY ALTERNATING CURRENT POWER SOURCES IN NUCLEAR POWER PLANTS The purpose of this memorandum is to provide the U.S. Nuclear Regulatory Commission (NRC) staff's updated response to the Advisory Committee on Reactor Safeguards (ACRS) letter dated July 26, 2021, (Agencywide Document Access and Management System (ADAMS) Accession Number: ML21202A149) on the proposed Revision 5 to Regulatory Guide 1.9, Application and Testing of Onsite Emergency Alternating Current Power Sources in Nuclear Power Plants.

During the 687th meeting of the Advisory Committee on Reactor Safeguards, July 7-9, 2021, the ACRS reviewed Proposed Draft Regulatory Guide (RG) 1.9, Revision 5. In addition, ACRS Digital Instrumentation and Control (DI&C) Systems Subcommittee (SC) reviewed this matter on June 25, 2021. In a letter dated, July 26, 2021, the ACRS provided conclusions and recommendations on proposed Revision 5 of RG 1.9. The staff responded to the ACRS on October 13, 2022, (ADAMS Accession No. ML21277A254) and this current memorandum is an update to that response.

The staff has carefully considered the Committees feedback to ensure the final draft adequately addresses the stated concerns as well as the needs of other internal and external stakeholders.

During consideration of the Committees feedback, the staff also reassessed the resources needed to complete the update process and resolve the concerns raised by ACRS and the priority of this activity in terms of both regulatory and safety need. Addressing the Committees concerns remains a key objective before issuing a revised RG 1.9. However, because of staff resource limitations and other Fiscal Year 22 high priority activities, the staff has decided to defer work on this RG update.

This deferral does not mean that work on this update will be permanently tabled, rather the update process itself will be deferred as other work is prioritized.
