10 CFR Part 50 and Part 52 licensees, ANI agencies, NIST, and other State and Federal agencies may provide items or services to licensees without undergoing evaluation or audit Received several questions from stakeholders regarding the applicability of this alternative to DOE laboratories National laboratories owned by the DOE are government-owned, contractor operated facilities, as such, they are NOT considered to be a Federal agency

If procuring basic components or safety-related services from a DOE lab, an audit is required to verify the labs quality assurance program meets Appendix B to 10 CFR Part 50 requirements NRC staff considering issuing a Regulatory Issue Summary to provide clarification to the industry NRC staff held 2 briefings with DOE staff to ensure understanding and alignment
