By letter dated January 10, 2022, (Agencywide Document Access and Management System
[ADAMS] No. ML22034A968), the Colorado Department of Public Health and Environment (CDPHE) requested U.S. Nuclear Regulatory Commissions (NRCs) staff comments on the technical bases of a licensing action. The subject of the licensing action is the use of High-Pressure Slurry Ablation (HPSA) technology on rock containing uranium.
The NRC staff has completed its review of CDPHEs technical bases supporting the licensing action. Overall, the NRC staff found your decision document logically constructed and appropriately focused on the regulatory issues and past decisions made by the NRC and CDPHE. Given that HPSA is a new technology, the NRC staff appreciates CDPHEs efforts to develop and document a clear rationale because clarity of regulatory decisions is one of the NRCs Principles of Good Regulation.
