Dear Mr. Lubinski:
In accordance with 10 Code of Federal Regulations (CFR) 70.32(i), American Centrifuge Operating, LLC (ACO) hereby submits to the U.S. Nuclear Regulatory Commission (NRC) changed pages of the Emergency Plan for the American Centrifuge Plant as Enclosure 1 of this letter. As documented within our Corrective Actions database, specifically Condition Notification #10349, changed pages for Revision 32 of the Emergency Plan for the American Centrifuge Plant, which became effective July 14, 2021, were not submitted within six months after the change. This reporting letter fulfills this six-month reporting requirement to regain compliance.
Design Analysis Calculation DAC-3901-0005, Evaluation of No Need for an Emergency Plan for the HALEU Demonstration, (Reference 1) provides ACO's evaluation stipulated in 10 CFR 70.22(i)( 1 )(i) to demonstrate that an Emergency Plan is not required under the current High Assay Low Enriched Uranium (HALEU) Demonstration program. However, upon full implementation of a new site-wide Emergency Plan and in accordance with 10 CFR 70.32(i), ACO will begin supplying changed pages to the affected off-site response organizations through the controlled distribution process.
The changes noted in Enclosure 1 have been reviewed in accordance with 10 CFR 70.32 and have been determined not to decrease the effectiveness of the applicable plan. Revision bars in the right hand margin depict changes from the previous revision submitted to the NRC.
