SAFEGUARDS INFORMATION FOR USE IN DESIGNING AN ADVANCED REACTOR (PROJECT NUMBER 99902049)
Dear Mr. Mayer:
The purpose of this letter is to provide you with the Safeguards Information (SGI) requested in the November 23, 2021, letter1 from SMR, LLC, a subsidiary of Holtec International (Holtec), for the designing of its SMR-160 small modular reactor. Specifically, SMR, LLC, requested the SGI necessary for consideration during the design of an advanced reactor, along with the beyond design basis, large commercial aircraft characteristics specified by the Commission that are referenced in Order EA-10-073.2 The NRC has reviewed the request and determined that SMR, LLC, has demonstrated a need-to-know, and the enclosed SGI will be handled through implementation and compliance with Holtecs SGI program, which will be extended to SMR, LLC. As noted in SMR, LLCs, November 23 letter, you are the approved reviewing official for the Holtec SGI program.
Consistent with Order EA-08-289,3 only you can make SGI access determinations for other individuals who have been identified by SMR, LLC, as having a need-to-know, who have been fingerprinted, and who have had a criminal history records check and a background check.

SAFEGUARDS INFORMATION SAFEGUARDS INFORMATION The enclosures to this letter contain SGI as described in Title 10 of the Code of Federal Regulations (10 CFR) 73.21, Protection of Safeguards Information: Performance Requirements, and will be withheld from public disclosure in accordance with 10 CFR 73.21 and 10 CFR 73.22, Protection of Safeguards Information: Specific Requirements. Enclosure 1 is Regulatory Guide (RG) 5.69, Guidance for the Application of Radiological Sabotage Design-Basis Threat in the Design, Development and Implementation of a Physical Security Program That Meets 10 CFR 73.55 Requirements (SGI), Revision 0, dated September 2007. is Nuclear Energy Institute (NEI) 17-03, Methodology for Performing Aircraft Impact Assessments for New Plant Designs, Revision 8, dated April 2011.
The NRC anticipates the issuance of Revision 1 to RG 5.69 in early calendar year 2022 and will provide a copy to you once issued.
