In accordance with 1 CFR part 51, we request that you approve the incorporation by reference of the material listed below into Title 10 of the Code of Federal Regulations (CFR). We have included the IBR material and draft final rule. We have included the published, paper copies of all IBR material as the exemption was previously approved (approval email enclosed). The material will be referenced in § 50.55a, as follows:

1 Section Ill of the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel (BPV) Code consists of several divisions. These divisions are broken down into subsections. The NRC is incorporating Division 1. Subsections for Division 1 are designated by capital letter preceded by the letter "N." Each subsection is published separately. The date of issuance for each subsection is the same as the entire Section Ill.

We have uploaded a draft of the final rule (RIN 3150-AK22) as well as emailed an MS Word file of the draft final rule, as well as an MS Word file for this letter, on March 30, 2022. We emailed the updated MS Word files for the draft final rule and letter on May 26, 2022.

You're one of (actually, you're "the") the agencies we know we may need to make some allowances for, but most agencies don't need to know about the exceptions. :)

Hi Miriam, On March 25, 2021, (86 FR 16087) NRC proposed to IBR the 2019 Edition of the American Society of Mechanical Engineers Boiler and Pressure Vessel Code and the 2020 Edition of the American Society of Mechanical Engineers Operation and Maintenance of Nuclear Power Plants, Division 1: OM Code: Section 1ST, for nuclear power plants.
Several years ago, when planning for this action, we purchased the 2019 standards in paper. When the staff determined to IBR additional standards, to comply with the OFR direction to submit all standards to be IBR in a final rule in the same format, we purchased the 2020 OM code sections and other codes in paper. The comment period for this activity closes tomorrow, and the staff estimates publication of the final rule in March 2022.
Please let me know the process for requesting a waiver to the requirement for electronic format.

[External_Sender] Incorporation by reference (IBR) changes and upcoming Handbook release Good afternoon, Please forward this email to anyone in your agency involved with IBR in your agency's regulations.
In June 2019, 0MB and the Archivist jointly released Memorandum M-19-21 which directed all Federal agencies to create, retain, and manage Federal records in electronic formats and to eliminate paper records.
As a result, OFR can no longer accept paper IBR material. (If you have a specific rulemaking with paper IBR material, contact OFR ASAP.) We have expanded the pilot el BR program, which allows agencies to securely transfer IBR request packages directly to a GPO server dedicated to OFR's IBR program. If your agency does not have an account, or if you are unsure if there is an account or of the account information, email OFR-Legal@gpo.gov.
We are also updating the IBR Handbook and expect to release a new edition by the end of June 2021. In addition to expanding the examples and making the instructions more clear, we are adding information regarding the new request process. We are also considering ways to make the Handbook more useful.
