Dear Mr. Blanch:
On behalf of the U.S. Nuclear Regulatory Commission (NRC) staff, I am responding to your correspondence dated November 12 and November 22, 2021, in which you requested a public dialog and a meeting with the NRC, in the vicinity of San Onofre Nuclear Generating Station (SONGS). You state that you seek to discuss the publics safety concerns regarding SONGS and to postpone the Commissions approval of SECY-21-0083, Planned Revisions to the Review Process for Title 10 of The Code of Federal Regulations 2.206 Petitions, Management Directive 8.11 and the Associated Desktop Guide.
The NRC is committed to considering all information and viewpoints in its decision making on nuclear safety matters. Doing so is consistent with the Principles of Good Regulation and our public meeting policy, as you note in your correspondence. To that end we have conducted extensive public outreach concerning SONGS, including public meetings and webinars held in November 2016, January 2019, March 2019, June 2019, August 2019, July 2020 (with the California Coastal Commission), and March 2021. While we always appreciate your insights and those of the community on these regulatory matters and believe your input strengthens our decision making, we also believe that as a result of these numerous recent interactions, the NRC staff thoroughly understands the range of views and technical concerns relevant to our regulatory decisions on the Public Watchdogs petition, as documented in the August 30, 2021, letter from Kevin Williams. We have not identified any information in your latest letter that has not been previously considered and addressed. We believe we have been responsive to the concerns that were raised through these communications with the public, and in the absence of new technical information that could bear upon our decision, we do not plan further public meetings on this matter. We will, however, continue our broader openness and public meeting activities associated with the SONGS site decommissioning.
With regards to your request to postpone the approval of SECY-21-0083, that information paper describes our update of the 2.206 petition process to address concerns raised in an Office of the Inspector General Report and recommendations made by an NRC Expert Evaluation Team.
Among other enhancements, we created a team dedicated to ensuring consistency in the process. In sum, these revisions to the 2.206 petition process support an increase in public confidence, ensure the timely review of petitions, and help to improve communication with petitioners and transparency for members of the public. This information has been incorporated
2 by addendum into Management Directive 8.11, and the associated Desktop Guide has been revised.
