LIMETREE BAY REFINING, LLC ACKNOWLEDGEMENT OF BANKRUPTCY NOTIFICATION
Dear Mr. Morgan:
This acknowledges the letter dated November 2, 2021, informing the U.S. Nuclear Regulatory Commission (NRC) that Limetree Bay Refining, LLC filed for bankruptcy under Chapter 11 in the U.S. Bankruptcy Court, for the Southern District of Texas.
Please be informed that the bankruptcy filing does not relieve Limetree Bay Refining, LLC and its subsidiaries of their obligations to comply with NRC requirements. We understand you have appropriately shuttered and locked the gauges.
You or your licensed contractor must notify us within 30 days of the removal of the devices for transfer or disposal and comply with the regulations in Title 10 of the Code of Federal Regulations § 31.5(c)(8). In addition, as a general licensee, you must still comply with applicable NRC requirements, including certain notification requirements, requirements that prohibit certain transfers, and requirements related to the application for an export license in certain situations. You should ensure that your attorney and any trustee involved in the bankruptcy proceeding are aware of these obligations.
Please notify us immediately if you are unable to meet any of these conditions. Also, please notify us when the bankruptcy proceeding is completed.
