USER NEED FOR RULEMAKING FOR AMENDMENT NO. 9 TO THE NAC INTERNATIONAL NAC-UMS STORAGE SYSTEM The following information is being provided to request correction of an administrative error in the recently completed rulemaking for NAC-UMS Amendment No. 8 and rulemaking support for the following Division of Fuel Management certification activity to amend Title 10, Code of Federal Regulations (10 CFR) Part 72 for NAC-UMS Amendment No. 9:

- 2. Use the following text for the purpose and scope of the correction to NAC-UMS Amendment No. 8 and rulemaking for NAC-UMS Amendment No. 9:
On July 30, 2021 (Agencywide Documents Access and Management System (ADAMS)
Package Accession No. ML21222A017), NAC International, Inc., (NAC) submitted an application to amend the NAC-UMS Storage System. NAC requested correction of effective thermal properties for PWR fuel assemblies used in the certification basis ANSYS thermal models and it updated some modeling assumptions.
The U.S. Nuclear Regulatory Commission (NRC) published a direct final rule on September 30, 2021, amending its spent fuel storage regulations by revising the NAC International, Inc. (NAC) NAC-UMS storage system listing within the List of approved spent fuel storage casks to include Amendment No. 8, to Certificate of Compliance (CoC) No. 1015. The direct final rule was effective on October 19, 2021. The technical specifications (TS) included three minor editorial and non-substantive errors. The purpose of this action is to correct these errors.
On Page B-2, the NRC inadvertently omitted listing package B-4. On what should have been Page B-4, the page number was listed as B-3, resulting in two pages with the same page number.
The amendment revision number in the footer on Page B3-2 of the Technical Specifications, Appendix B, should have been changed from Amendment No. 7 to Amendment No. 8, but was not. Correcting this error would not change the substantive responsibilities of any person or entity regulated by the NRC. This document corrects this error. The corrected page can be found at ADAMS Accession No. ML21312A499.

Package Accession No. ML20293A102), NAC requested renewal of Certificate of Compliance No. 1015.
Pursuant to 10 CFR 72.240, since the renewal application was submitted at least 30 days prior to expiration of the certificate, the existing certificate (and all amendments) will not expire until the application for renewal has been determined by the NRC.

The proposed CoC, Technical Specifications, and preliminary safety evaluation report (SER) have been placed in ADAMS (see references below) and are available for your use in the rulemaking package. DFM will designate these documents as Official Agency Records after the Executive Director for Operations has approved the rulemaking package (ADAMS Package No. ML21312A487).
The Office of the General Counsel has reviewed this memorandum with its referenced documents and has no legal objection to its contents.
