Thank you for your response to the U.S. Nuclear Regulatory Commissions (NRC) correspondence regarding the Letter of Intent from the State of Indiana. Additionally, thank you for bringing to our attention the change in elected Tribal leadership. We will update our internal systems to note the change.
The purpose of our letter was to conduct outreach to Tribes and to inform them of the NRCs receipt of the Letter of Intent from the State of Indiana to become an Agreement State. No specific review is being requested at this time.
If you have any additional questions or would like to discuss the Agreement State review and approval process, please contact myself or Duncan White (duncan.white@nrc.gov).

The Quapaw Nation Historic Preservation Office has received the review request you have submitted.
Please note that the Quapaw Nation elected tribal leader contact information which you have on file appears to be out of date. Former Chairman Berrey is no longer an elected official of the Quapaw Nation. Please find updated contact information attached to this email.
Your letter does not clarify what type of request is being made. As stated in your correspondence, you believe that the transfer of regulatory authority from the NRC to the State of Indiana would not be considered an undertaking subject to 106 review. Without additional information, I cannot agree with that determination. Typically actions which would result in the loss of a federal nexus are considered to be an undertaking subject to review. Nevertheless, if your letter is not a request for review in accordance with 36 CFR 800 then we are most likely not the correct point of contact.
Please clarify the nature of your request citing the appropriate CFR compliance code and your request will be provided to the correct tribal department for review.

Good afternoon Quapaw Tribe,
In accordance with the NRCs Tribal Policy statement, which promotes tribal outreach to keep Indian Tribes informed about the agency actions and plans, the NRC has received a letter from the Governor of Indiana of their intent to enter into an Agreement with the NRC to regulate academic, industrial, and medical facilities within their borders.
