SUMMARY

OF AUTHORIZING OFFICIAL WORKSHOP HELD WITH FUEL CYCLE ENRICHMENT LICENSEES ON OCTOBER 13, 2021 On October 13, 2021, the U.S. Nuclear Regulatory Commission (NRC) staff hosted a workshop to discuss NRCs role as the Authorizing Official for Classified Networks. The participants included staff from Global Laser Enrichment, Louisiana Enrichment Services doing business as Urenco USA, American Centrifuge Operating, and the Nuclear Energy Institute. The NRC staff included representatives from the Office of Nuclear Security and Incident Response, Office of the Chief Information Officer, Nuclear Material Safety and Safeguards, Office of the General Council, and Region II.

The purpose of the closed workshop was to discuss the NRCs role as the authorizing official for licensees classified systems. The NRC staff explained the expectation for facilities to move toward implementation of the latest National Institute of Standards and Technology (NIST) standard, e.g., current NIST-800 Special Publication 53, Revision 5, to retain authorization to operate the classified networks. The NRC staff also discussed the recently issued rulemaking 32 Code of Federal Regulation (CFR) Part 117, National Industrial Security Program Operating Manual, which applies to the enrichment facilities.

The NRC offered to work with each of the three enrichment licensees to determine which requirements of 32 CFR Part 117 are applicable. The Office of General Counsel staff addressed questions about backfit. The staff plans to follow up with the licensees to address their questions related to Security Executive Agent Directive (SEAD) 3 reporting, eligibility for Department of Defense training, Counterintelligence reporting, and also should unclassified networks be monitored the same as classified networks.
