Good afternoon Alyse, I do not think we have corresponded directly in the past, but I am the NRC project manager for the West Valley site after succeeding Amy Snyder, and I will actually soon be departing myself for maternity leave, so I have also cced Pamela Longmire, who will be covering West Valley in my absence. In any case, HELLO! I hope all is well in New York and that you avoided most of the severe weather.

I wanted to let you know that the agency is preparing to issue a license amendment, as well as an associated Environmental Assessment / Finding of No Significant Impact (EA/FONSI), within the next

several weeks, which will implement a revision to the NYSERDA Radiation Protection Plan for the Retained Portion of the WNYNSC, as discussed in the NYSERDA submittals dated March 11, 2020, October 28, 2020, and July 15, 2021 (ADAMS Accession Nos. ML20076C310, ML20311A200, and ML21202A212, respectively). The EA/FONSI will be published in the Federal Register prior to issuing the amendment, and supports the staffs proposed determination that the amendment poses no significant environmental impact. The EA/FONSI will also likely be the place where we address the public comments received on the initial No Significant Hazards Consideration FRN (published on March 10, 2021; 86 FR 13762).

As you probably know as well as anyone, the NYSERDA amendment revises the CSF-1 license to approve updated radiation protection requirements for the retained premises of the WNYNSC.

Specifically, NYSERDA requested addition of a license condition requiring the implementation of a new Radiation Protection Plan to address the retained premises in order to modernize the radiation protection portions of License No. CSF-1, as well as simplify NYSERDAs radiation protection requirements for the retained premises. The retained premises is defined as the area consisting of the WNYNSC not including the U.S. Department of Energy West Valley Demonstration Project premises and the State Licensed Disposal Area. In addition, NYSERDA requested that the license be amended to clarify NYSERDAs health and safety responsibilities under License No. CSF-1 given that portions of the license are in abeyance in accordance with the provisions of the West Valley Demonstration Project Act.

This is a little bit of a strange situation where I am requesting official state comments from the organization which is also the licensee for this action, so if you/NYSERDA want to share this with any of your NYSDEC, NYSDOH, or EPA counterparts please feel free to do so. This amendment and EA/FONSI are still in draft and subject to minor changes as they go through the final review phase, but should represent pretty close to the final versions for this action. Should you have any questions, or if the State of New York would like to make any official comments on the proposed changes or the proposed environmental determination, please let me know by September 17th and I can be sure they are incorporated into the final version of the amendment.
