Dear Mr. Noordennen,

I am writing to provide you with an update on the February 22, 2019, petition for rulemaking (PRM) that you submitted to the U.S. Nuclear Regulatory Commission (NRC) and amended on January24,2019 (Agencywide Documents Access and Management System (ADAMS)

Accession No.ML19079A293). On March 20, 2019, the NRC docketed your petition pursuant to §2.803 of Title10 of the Code of Federal Regulations (10CFR), "Petition for rulemaking NRC action," and assigned it Docket No.PRM50119. Please reference this docket number on any correspondence you may have concerning the petition. On June 12,2019, the NRC published a notice of docketing and a request for comment for your petition (84 FR 27209). The comment period closed on August 26,2019.

In your petition, you requested the NRC to revise the definition of decommissioning in

§50.2, Definitions, and to amend §50.82, Termination of license, to allow access to the decommissioning trust fund to be used for the cost of disposal of major radioactive components before the permanent cessation of operations at nuclear power plants. You also suggested that granting the petition will remove unnecessary burden from licensees who store major radioactive components on their sites during plant operations because they cannot use decommissioning funds for disposal of these components.

The NRC is reviewing your petition and the public comments received in response to the June 12,2019, Federal Register notice. The Commission makes the final decision on the NRCs actions on petitions for rulemaking. After reviewing the merits of your petition and the public comments, the NRC staff prepares a recommendation to the Commission and the Commission will then make and issue its decision.
