NRC REGULATORY ISSUE SUMMARY 2009-06, REVISION 1,

IMPORTANCE OF GIVING THE NRC ADVANCE NOTICE OF INTENT TO

PURSUE LICENSE RENEWAL

ADDRESSEES

All holders of operating licenses for nuclear power reactors un der the provisions of Title 10 of

the Code of Federal Regulations (10 CFR) Part 50, Domestic Licensing of Production and

Utilization Facilities, except those that have permanently cea sed operations and from which

fuel has been permanently removed from the reactor vessel, as c ertified by the license holder.

INTENT

The U.S. Nuclear Regulatory Commission (NRC) is issuing this re vised regulatory issue

summary (RIS) to emphasize to licensees the importance of (1) g iving the NRC advance notice

of their plans for license renewal and (2) notifying the NRC of changes in previously announced

plans for license renewal. Responses to this RIS will allow th e NRC staff to plan better and to

budget for the reviews of applications submitted in accordance with 10 CFR Part 54,

Requirements for Renewal of Operating Licenses for Nuclear Pow er Plants. This RIS does

not transmit or imply any new or changed requirements or staff positions. The submission of

advance notice of addressee plans or changes to previously anno unced plans is strictly

voluntary; therefore, no specific action or written response is required.

BACKGROUND

The NRC issued RIS 2000-20, dated November 14, 2000; RIS 2003-0 2, dated

February 3, 2003; and RIS 2009-06, dated June 15, 2009, all tit led, Importance of Giving NRC

Advance Notice of Intent to Pursue License Renewal, to emphasi ze to licensees the

importance of notifying the agency of their plans for submittin g license renewal applications.

Responses to these requests have allowed the NRC to plan for li cense renewal applications

projected through fiscal year (FY) 2021. The NRC will use the information already received to

begin the FY 2024 budgeting process. The review of renewal app lications involves significant

NRC resources, and the number of applications and their submiss ion dates greatly impact

resource requirements. Voluntary submission of licensee plans for license renewal will assist

the NRC in its planning and budgeti ng processes. When letters of intent are received with

sufficient advance notice, the NRC will strive to include resou rces in the budget to review them.

If needed, the NRC will prioritize b ased on expected submission dates. The staff will review any

submissions beyond those with letters of intent submitted with sufficient advance notice as

resources become available.

As of the date of this RIS, the NRC has received the following information from licensees about

future plans to submit license renewal applications.

The NRC staff maintains an updated list of planned initial license renewal application

submissions on its public Web sites at

SUMMARY OF ISSUE

To improve the accuracy of resource forecasts, the NRC requests that all power reactor

licensees submit advance notice if they intend to pursue licens e renewal, including potential

plans for requesting a second renewed operating license. Licen see responses should provide

the anticipated schedule for filing the license renewal applica tion. The agency also encourages

licensees to notify the NRC, as soon as possible, of any change s to previously announced

license renewal application submittal dates. Due to the substa ntial resources that must be

allocated for each application review, the NRC uses this inform ation for planning and budgeting

purposes. The NRC requests notification of intent to submit a license renewal application

before the August 3 years before the fiscal year of submittal. For example, the NRC would

budget for an application submitted in FY 2026 if the licensee notified the NRC before

August 2023. The NRC will assess applications submitted withou t such advance notice using

the integrated planning, budgeting, and performance management process and will schedule

the review to the extent practical on a case-by-case basis. A licensee may submit an affidavit

pursuant to 10 CFR 2.390(b) to have information withheld from p ublic disclosure if the licensee

determines that information about license renewal application s ubmission is proprietary in that it

represents confidential financial or commercial information. T he affidavit should contain the

basis for withholding the information from public disclosure.

VOLUNTARY RESPONSE

Addressees that choose to provide advance notice of their inten t to pursue license renewal, or

to notify the NRC of changes to previously announced schedules for submitting license renewal

applications, should send their responses to the U.S. Nuclear R egulatory Commission, ATTN:

Document Control Desk, Washington, DC 20555-0001. The NRC staf f is requesting

addressees to respond to this RIS by August 2023 to ensure that their license renewal plans are

appropriately considered in the NRCs FY 2025 budget. The NRC staff also requests the

voluntary submission of addressee plans, when available, to pur sue license renewal after

FY 2025. This information will assist the NRC staff in plannin g for future NRC budgets.

BACKFIT DISCUSSION

The NRC is issuing this RIS to request the voluntary submission of information. The agency will

use this information for internal NRC planning and budgeting. This RIS does not affect the

licensee procedures necessary for operating a power plant and r equires no action or written

response. Any action is strictly voluntary on the part of addr essees to provide advance notice of

their intent to pursue license renewal, or to notify the NRC of changes to previously announced

schedules for submitting license renewal applications, in accor dance with this RIS for the

purpose of aiding the NRC in planning the use of its resources. Therefore, this is not a backfit

under 10 CFR 50.109, Backfitting, and the staff did not perfo rm a backfit analysis.

FEDERAL REGISTER NOTIFICATION

The NRC did not publish a notice of opportunity for public comm ent on this RIS in the Federal

Register because it pertains to an administrative aspect of the regulato ry process that involves

the voluntary submission of information by addressees and does not represent a departure from

current regulatory requirements.

CONGRESSIONAL REVIEW ACT

This RIS is not a rule as designated in the Congressional Revie w Act (5 U.S.C. §§ 801-808)

and, therefore, is not subject to the Act.
