For Agreement States, does your program have an oversight board or committee which provides direction to the program and is composed of licensees and/or members of the public? If so, please describe the procedures used to avoid any potential conflict of interest.

The Program receives advice and direction from two advisory panels, the Radiation Technical Advisory Council (RTAC) and the Environmental Improvement Board (EIB).

The RTAC members are required to have scientific or medical backgrounds and they can be radioactive material licensees. Presently there are no known licensees on the RTAC.

The EIB is the rule promulgating authority for radiation and all other Department programs. No members of the EIB are licensees.

1. Nypro Healthcare Baja Inc. GI316-17 (significant amendment-change of ownership) is Part 37 category 1.
2. Presbyterian Hospital Center MI170 (significant amendment -Irradiator removed from their license) is Part 37 category 2.

From March of 2020 to 2021 all inspections have be done virtually with the exception of UNMH BM 233 and UNM Radiopharmacy RP479. The changes implemented were due to COVID restrictions. Also, the accompanied inspection by NRC were allowed during August of 2021.

No changes to written licensing procedures, no new procedures, other than changes to regulations based on compatibility requirements as an agreement state, with the latest rule revision approval after January 25, 2021, presentation to the New Mexico Environmental Improvement Board.

Policy changes were made to all teleworking during COVID and to limit in person inspections March 2020 to current 2021 year.

1. Lovelace Biomedical Research Institute BB496 - Inventory and Financial Assurance; the licensee inventory, to date, has not been accurately identified. NMED/RCB issued an ACO and is currently working with the licensee and a third party to comply with 20.3 NMAC.
2. UniTech Services Group, Inc. LA110 - Decommissioning cost for the current license site requires an evaluation of their submitted Financial Assurance.
