September 10, 2021

John R. Tappert, Director Division of Rulemaking, Environmental, and Financial Support Office of Nuclear Material Safety and Safeguards U.S. Nuclear Regulatory Commission Washington, D.C. 20555-0001

Dear Mr. Tappert:

The U.S. Environmental Protection Agency (EPA) has reviewed the Final Environmental Impact Statement (EIS) for Interim Storage Partners LLCs License Appl ication for a Consolidated Interim Storage Facility for Spent Nuclear Fuel in Andrews County, Texas. Our review is provided pursuant to the National Environmental Policy Act (NEPA), the Council on Environmental Quality regulations (40 CFR Parts 1500 - 1508), and our NEPA review authority under Section 309 of the Clean Air Act.

The Final EIS evaluates the construction and operation of a consolidated interim storage facility for spent nuclear fuel and Greater-Than-Class C waste, along with a small quantity of spent mixed oxide fuel. Based upon our review of the environmental analysis provided, EPA has no comments to offer on the proposed action.

We appreciate the opportunity to review this Final EIS. If you have any questions, please contact Eli Martinez, the project review lead, at (214) 665-2119 or martinez.eli@epa.gov.

Sincerely,

RobertHouston StaffDirector Office of Communities, Tribes and Environmental Assessment
