Dear Mr. Chairman:

The U.S. Nuclear Regulatory Commission (NRC) is publishing the following document in the Federal Register:

Title:

Items Containing Byproduct Material Incidental to Production.

  • Description of the document: The proposed rulemaking would revise the NRC regulations by adding exemptions from licensing and its associated distribution requirements for a specific group of irradiated products that contain a minor amount of residual radiation incidental to the production process, which does not present a risk to public health and safety. These irradiated products are widely used in a variety of beneficial applications, including research, medical, pharmaceutical, academic, scientific, and industrial applications. Additionally, a new safety criteria would be formed as the primary means of providing reasonable assurance of adequate protection of public health and safety.
  • Dates: The public comment period for the proposed rule closes 75 days after publication.
