September 8, 2021 ALL AGREEMENT STATES, CONNECTICUT, INDIANA NON-AGREEMENT STATES STATE LIAISON OFFICERS FEDERALLY RECOGNIZED TRIBES NRC NMSS, NRC REGIONS I, III AND IV EXTENSION OF COMMENT PERIOD FOR INTERIM PROCEDURE SA-700, PROCESSING AN AGREEMENT (STC-21-018A)

Purpose:

To inform the National Materials Program (NMP) community (States and U.S.

Nuclear Regulatory Commission (NRC)) and Federally Recognized Tribes that the Office of Nuclear Material Safety and Safeguards (NMSS) has extended the comment period for State Agreements (SA) procedure SA-700, Processing an Agreement.

Background:

On April 7, 2021, NRC staff issued Notification of the Issuance, and Opportunity to Comment on the Interim Procedure SA-700, Processing an Agreement (STC-21-018) to inform the NMP community and Federally Recognized Tribes that NMSS procedure SA-700 has been approved for use as an interim procedure and to provide an opportunity to comment on the interim procedure. The comment period for the interim procedure is scheduled to end on October 15, 2021.

Discussion: On June 11, 2021, the Governor of Indiana submitted a Letter of Intent to become an Agreement State. Given that a second State is pursuing an Agreement with the NRC and to ensure able opportunity for the NMP community and Federally Recognized Tribes to provide comments on the interim procedure and in particular Appendix E to the SA-700 Handbook Tribal Interactions During the Agreement Process, NRC staff is extending the comment period for the interim SA-700 procedure.

The comment period1 has been extended to January 31, 2022. Please provide comments to the contact person listed at the end of this letter.

This procedure has been uploaded to the state communications portal Web site for use, and for review and comment: https://scp.nrc.gov/procedures.html. The procedure and handbook can be also found in ADAMS under Accession Nos. ML21082A067 and ML21082A081.
