VERIFICATION OF THE THREE MILE ISLAND SECURITY PLAN, TRAINING AND QUALIFICATION PLAN, SAFEGUARDS CONTINGENCY PLAN, AND IMPLEMENTATION OF ORDER EA-20-103 - ADDITIONAL SECURITY MEASURES AND FINGERPRINTING FOR UNESCORTED ACCESS FOR THREE MILE ISLAND NUCLEAR STATION UNIT 1 INDEPENDENT SPENT FUEL STORAGE INSTALLATION

Dear Mr. Rhoades:

The purpose of this letter is to provide written verification that the U.S. Nuclear Regulatory Commission (NRC) has completed its review of Three Mile Island (TMI) Security Plan, Training and Qualification Plan, and Safeguards Contingency Plan, Revision 24 (PSP) which was submitted by Exelon Generation to the NRC by letters dated January 28, 2021 and February 16, 2021 (Agencywide Documents Access and Management System [ADAMS]

Accession No. ML21036A023 and ML21070A189, respectively). NRC staff review has determined that the submitted PSP is acceptable and the TMI PSP Revision 24 meets the applicable performance objectives and general requirements outlined in Title 10 of the Code of Federal Regulations (10 CFR), Section 73.55, and the additional security measures imposed by NRC Order EA-20-103.

By letter dated August 27, 2020 (ADAMS Accession No. ML20224A121), NRC issued Order EA-20-103, Issuance of Order for Implementation of Additional Security Measures and Fingerprinting for Unescorted Access at the Three Mile Island Generating Station Independent Spent Fuel Storage Installation. The Order required compliance with additional security measures (ASMs) for physical protection, access authorization and fingerprinting at the TMI Independent Spent Fuel Storage Installation (ISFSI).

In accordance with Order EA-20-103, the licensee must receive written verification from the NRC that it has adequately demonstrated compliance with Order EA-20-103 requirements before initially placing spent fuel in the ISFSI. On September 15, 2020, the licensee responded to the Order (ADAMS Accession No. 20259A196). On June 15, 2021 (ADAMS Accession No. ML21167A010), pursuant to 10 CFR 72.212, the licensee notified the NRC that it intends to store TMI unit 1 spent nuclear fuel in an ISFSI and intends to use the General License granted under 10 CFR 72, Subpart K.

D. Rhoades A physical security inspection (Inspection Report No. 07200077/2021401) of the TMI ISFSI was completed on July 20, 2021 (ADAMS Accession No. ML21194A076), which verified the PSP successfully meets the objectives outlined in NRC Inspection Procedure 81311, Physical Security Requirements for Independent Spent Fuel Storage Installation (ADAMS Accession No. ML20265A169) Based on staffs observations, the TMI PSP Revision 24 meets the performance objectives and general requirements outlined in 10 CFR 73.55 and the ASMs imposed by the NRC. Additionally, NRC staff completed a review of TMI PSP Revision 24 on August 10, 2021 (ADAMS Accession No. ML21218A008), which found that the submitted PSP to be acceptable and the PSP meets the applicable performance objectives and general requirements outlined in 10 CFR 73.55 and the ASMs imposed by the NRC Order EA-20-103.

Exelon is authorized to use the ISFSI, effective immediately.

In accordance with 10 CFR 2.390 of the NRC's "Agency Rules of Practice and Procedure," a copy of this letter will be available electronically for public inspection from the Publicly Available Records component of ADAMS. ADAMS is accessible from the NRC Web site at https://www.nrc.gov/reading-rm/adams.html.
