Dear Mr. Warden:

Enclosed is an application (XSNM3822), dated July 7, 2021, received by the U.S. Nuclear Regulatory Commission (NRC), from the U.S. Department of Energy, National Nuclear Security Administration, Y-12 National Security Complex. The application requests the export of 121.6 kilograms (kg) of uranium enriched up to 19.95 WGT% in uranium-235 (maximum of 24.0 kg U-235) in the form of two types of reactor fuel (uranium silicide plates and uranium molybdenum coupons) to Japans Kyoto University Research Reactor Institute for use in the Kyoto University Critical Assembly.

Assurances from Japan that the material will be subject to all the terms and conditions of the agreement for cooperation are required. Your assistance in obtaining the necessary assurances is requested.

Please note that while the material proposed for export is of U.S. origin, it is being fabricated into fuel in France. Therefore, EURATOM is expected to apply obligations to the material upon shipment from France to the United States, prior to it being exported from the United States to Japan under this proposed license.
