Dear Ms. Gayheart:

The Nuclear Regulatory Commission (NRC) Office of Investigations (OI) has closed the subject case to determine whether Southern Nuclear Company (SNC) or contractor employees deliberately violated SNC procedures at the Joseph M. Farley Nuclear Plant.

The NRC determined that based upon the evidence developed during the investigation there was insufficient evidence to substantiate the allegation that SNC or contractor personnel deliberately violated SNC procedures by not inputting the actual work hours for covered workers into a SNC procedurally required database knowing it would result in 10 CFR Part 26 violations. We plan no further action with regard to this matter. Should you have any questions concerning this letter, please contact us.
