OF JULY 15, 2021, PUBLIC MEETING TO ADDRESS NEI COMMENTS ON REVISION 1 TO REGULATORY GUIDE 5.75, TRAINING AND QUALIFICATION OF SECURITY PERSONNEL AT NUCLEAR POWER REACTOR FACILITIES On July 15, 2021, an Observation Public Meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives from the Nuclear Energy Institute (NEI).

The videoconference was noticed on the NRCs public website on June 29, 2021, and the meeting notice and agenda are available in the Agencywide Document and Access Management System (ADAMS) at Accession No. ML21179A333. The purpose of the meeting was to discuss Revision 1 of Regulatory Guide (RG) 5.75, Training and Qualification of Security Personnel at Nuclear Power Reactor Facilities, as requested by the NEI. Specifically, the meeting addressed comments and questions posed by the NEI in a letter from William R. Gross dated April 14, 2021 (ADAMS Accession No. ML21175A174), and in an email from A.J. Clore dated June 8, 2021 (ADAMS Accession No. ML21180A259).

Discussion The NRC staff opened the meeting with introductory remarks. The NRC staff discussed the following topic areas during its slide presentation: (1) licensees commitment to RG 5.75, Revision 0 versus Revision 1; (2) Critical Task List and the Knowledge, Skills, and Abilities Matrix; (3) expectations related to the Mock Adversary Force; (4) RG 5.75 conflicts with RG 5.81, with respect to adversary interference; and (5) annual participation requirements. The NRC staffs response to NEIs comments and questions can be found in the presentation slides, which are located in ADAMS at Accession No. ML21194A092.

Questions/Comments Provided to the NRC Staff indicated it was not actively soliciting comments toward regulatory decisions at this meeting; however, the Observation Meeting provided attendees with the opportunity to ask questions of the NRC staff or make comments about the issues discussed. Two comments were received during the meeting. A.J. Clore, NEI, commented that NEI was appreciative for the public meeting and that NRCs slide presentation was responsive to their comments and questions. Edwin Lyman, Union of Concerned Scientists, commented that he was perplexed as to why the NRC would allow licensees to continue to use an older version of a regulatory guide (RG 5.75, Revision 0), when an update had been issued (RG 5.75, Revision 1).

The same question, posed by two different individuals, was provided during the meeting.

Chris Newton, Duke Energy, and Susan Perkins, NEI, both asked whether licensees who had committed to RG 5.75 prior to Revision 1s issuance in March 2021, but had failed to indicate a revision number in their licensing basis, needed to submit a security plan change to specify their commitment to Revision 0? During the meeting NRC staff indicated that if a licensee had committed to a regulatory guide in its licensing basis, but failed to indicate a revision number, the licensee should submit a security plan change to specify the revision number to avoid any potential confusion for NRC inspectors.

After the meeting, NRC staff internally discussed the question posed by Mr. Newton and Ms. Perkins. Staff determined that licensees do not need to update their security plans just to specify a revision number for RG 5.75. As long as a security plan is dated prior to March 2021 (i.e., the issue date for RG 5.75, Revision 1), the NRC and its inspectors will recognize that a licensee has committed to Revision 0. If a licensee should determine a security plan change is necessary on or after March 2021, licensees should take the opportunity at that time, to also specify which revision of RG 5.75 they committed to, if any. Staff has contacted NEI, Entergy, and NextEra Energy representatives to acknowledge that the NRC reconsidered its original response and decided the staffs revised position is a more efficient path forward.

Conclusion NRC staff successfully responded to the questions and comments submitted in NEIs correspondence, as well as those provided by attendees. The NRC staff made no regulatory decisions during the meeting. There were no follow-up items or actions resulting from the meeting.
