BYRON STATION, UNIT NOS. 1 AND 2 - EXEMPTION FROM THE REQUIREMENTS OF 10 CFR 73.55(p)(1)(i) AND (p)(1)(ii) RELATED TO THE SUSPENSION OF SECURITY MEASURES IN AN EMERGENCY OR DURING SEVERE WEATHER (EPID L-2020-LLE-0154)
Dear Mr. Rhoades:
The U.S. Nuclear Regulatory Commission (NRC) approves the enclosed exemption from specific requirements of Title 10 of the Code of Federal Regulations (10 CFR) Sections 73.55(p)(1)(i) and 73.55(p)(1)(ii) for the Byron Station, Unit Nos. 1 and 2 (Byron). This action is in response to your application for an exemption dated September 28, 2020 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20272A212), to allow either a licensed senior operator or a certified fuel handler to approve the suspension of security measures in an emergency or during severe weather after the certifications required by 10 CFR 50.82(a)(1)(i) and (ii) have been submitted.
Currently, 10 CFR 73.55(p)(1)(i) and (ii) require that suspension of security measures in an emergency must be approved as a minimum by a licensed senior operator and that suspension of security measures during severe weather must be approved as a minimum by a licensed senior operator, with input from the security supervisor or manager, before taking these actions.
By letter dated September 2, 2020 (ADAMS Accession No. ML20246G613), Exelon Generation Company, LLC provided formal notification to the NRC pursuant to 10 CFR 50.82(a)(1)(i) and 10 CFR 50.4(b)(8) of the intention to permanently cease power operations at Byron on or before September 30, 2021.
Although the exemption is effective upon receipt, the actions permitted by the exemption may not be implemented at Byron until both the certification of permanent cessation of operations and the certification of permanent fuel removal have been submitted in accordance with 10 CFR 50.82(a)(1)(i) and (ii).
A copy of the exemption is enclosed. The exemption has been forwarded to the Office of the Federal Register for publication.
