SUMMARY

OF JULY 13, 2021, PRE-SUBMITTAL TELECONFERENCE WITH WOLF CREEK NUCLEAR OPERATING CORPORATION REGARDING A TEMPORARY EMERGENCY PREPAREDNESS EXERCISE EXEMPTION REQUEST FOR WOLF CREEK GENERATING STATION, UNIT 1 (EPID L-2021-LRM-0064)

On July 13, 2021, an observation public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Wolf Creek Nuclear Operating Corporation (the licensee) by teleconference. The purpose of the pre-submittal teleconference was to discuss a potential temporary exemption request that would postpone the Wolf Creek Generating Station, Unit 1 (Wolf Creek), biennial emergency preparedness exercise until the summer of 2022, tentatively. The licensee had provided background information for the teleconference, which is available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML21179A089. The meeting notice and agenda, dated June 30, 2021, are available in ADAMS at Accession No. ML21181A298. A list of attendees is provided in the enclosure.

The licensee indicated that the proposed temporary exemption would support the continued implementation of the isolation activities (e.g., social distancing, group size limitations, self-quarantining, etc.) to protect required emergency response organization personnel in response to the Coronavirus Disease 2019 (COVID-19) public health emergency. In addition, the States priority through 2021 is on COVID-19 vaccine distribution. The licensee indicated that the Kansas Division of Emergency Management supports, and the Federal Emergency Management Agency (FEMA) approves postponing the Wolf Creek biennial emergency preparedness exercise until no later than November 2022. The licensee cited the NRC staff approval of similar exemptions. The licensee planned to submit the exemption request by July 23, 2021.

During the teleconference, the NRC staff commented on the importance of following the NRCs Office of Nuclear Security and Incident Response (NSIR) Temporary Staff Guidance (TSG),

TSG-NSIR-2020-01, COVID-19 Related Exemptions from NRC Regulations - Emergency Preparedness Exercises (ADAMS Accession No. ML20196M030) in preparing the exemption request to expedite the NRC staff review. Although the Wolf Creek exercise was scheduled for November 2021, the NRC staff indicated that the licensee would not be out of compliance until the end of 2021. The NRC staff also commented that the licensee should:

submit a quality exemption request as soon as practicable, include copies of the letters from offsite organizations and FEMA,

address special circumstances per Title 10 of the Code of Federal Regulations Section 50.12, discuss coordination with NRC Region IV, and consider precedence approved by the NRC.

During the public comments period of the teleconference, representatives from the offsite organizations for the Wolf Creek exercise expressed their full support of the licensees exemption request. No public meeting feedback forms were received. No regulatory decisions were made at this meeting.
