NRC Staff Set 4 Clarification Question for the Kairos Quality Assurance Program Topical Report (KP-TR-007-NP)

Wednesday, July 07, 2021 6:47:00 PM Mr. Price, The NRC staff has developed a clarification question (below) to improve its understanding of the information presented in the Quality Assurance Program (QAP) Topical Report (TR). The question is intended to:
Obtain clarification regarding material in the topical report Promptly identify areas where additional information may be needed Facilitate discussions and continue effective communication
The NRC staff requests that Kairos propose a time to discuss the question in a public meeting.
Clarification Question Regarding Applicable TMI requirements for Kairos QAP
Revision 3 of Kairos QAP TR, KP-TR-007-NP, states in part that:
The QAP has been prepared in accordance with the requirements of Title 10, Part 50 of the Code of Federal Regulations (10 CFR 50), Domestic Licensing of Production and Utilization Facilities, Appendix B, Quality Assurance Criteria for Nuclear Power Plants and Fuel Reprocessing Plants.
The QAP TR was provided to support the design, construction, and operations phase activities for the Kairos Power Fluoride Salt-Cooled High Temperature Reactor (KP-FHR) design. As such Kairos requested NRC staff review and approval of the topical report to be used to satisfy QA requirements for use by nuclear power plant applications submitted in accordance with 10CFR Part50 and Part 52 including those in support of a standard design approval (SDA), design certification (DC),
early site permit (ESP), limited work authorization (LWA), construction Permit (CP),
operating license (OL), and/or a combined license (COL).
The staff notes that the requirements in 10 CFR 50.34(f)(3)(ii) and (iii) (TMI requirements) are applicable to certain Part 52 applications (including COLs, DCs, and SDAs) as they provide additional detailed criteria for proper implementation of Appendix B requirements. Kairos QAP TR does not describe how the requirements of 10 CFR 50.34(f)(3)(ii) and (iii) are met.
For the Kairos QAP TR to fully support compliance with QA requirements for COL, DC, and SDA applications, the TR must provide
a description that demonstrates how its QAP meets the requirements in 10 CFR 50.34(f)(3)(ii) and (iii).
