Pursuant to 10 CFR 50.54(q)(4) and 10 CFR S0.4(b)(S), DPC hereby submits a proposed change to the la Crosse Boiling Water Reactor (LACBWR) Independent Spent Fuel Storage Installation (ISFSI) Emergency Plan (E-plan}. As required by 10 CFR 50.54(q)(4), DPC requests an amendment to the facility operating license listed above in accordance with 10 CFR 50.90. The State of Wisconsin is also being notified, with a copy of tnis application, as required by 10 CFR S0.91(b)(1).
Enclosed is the proposed revision 40 of the LACBWR ISFSI Emergency Plan. These changes have been determined to decrease the effectiveness of the Emergency Plan in accordance with requirements of 10 CFR 50.54(q) and require prior NRC approval.
The major changes, requiring NRC approval, are made to adopt changes implemented by NAC-MPC Amendment No. 7 to 10 CFR 72 Certificate of Compliance (CoC) 1025 and NAC-MPC FSAR Revision 12, removing the requirement for the Post Event ISFSI Surveillance.

The revised Medical Drill frequency will be based upon Gundersen Health System's community-based risk assessment, emergency plan and compliance with 42 CFR 482.15, "Condition of participation: Emergency preparedness".

The proposed change has been reviewed considering the requirements of 10 CFR 50.54(q), the planning standards of 10 CFR S0.47(b), 10 CFR SO Appendix E, and the Emergency Plan. The above changes and changes identified in Enclosure 1 have been determined to decrease the effectiveness of the Emergency Plan and require NRC approval.
The entire E-plan (Enclosure 2) has been revised, including other changes not requiring NRC approval. The changes with do not require NRC approval are provided as "information only".
The proposed E-plan is scheduled to be issued as Revision 40. to this letter provides a description of the changes, the reason for the proposed change, and the basis for concluding that the proposed change continues to meet the requirements of 10 CFR Part SO Appendix E and the planning standards of 10 CFR S0.47(b)1* provides the revised Emergency Plan reflecting the proposed changes. Enclosure 3 provides a calculation specific to LACBWR ISFSI which supports the EAL proposed threshold value.
The Emergency Plan (Enclosure 2} is identified as 10 CFR 2.390(d). DPC requests that the NRC withhold Enclosure 2 from public disclosure pursuant to 10 CFR 2.390(d), as described in RIS 2005-031 revision 1.
DPC requests approval of the proposed changes to the Emergency Plan within 12 months, with the amendment being implemented within 60 days of issuance of the amendment. The Emergency Plan revision has been through a technical review and executive level approval for submittal to the NRC.
