LGC GLOBAL CORPORATION - PROPOSED IMPOSITION OF $22,500 CIVIL PENALTY; NRC INSPECTION REPORT (NON-LICENSEE/2019-001(DNMS))

Dear Mr. Rachmale:

This letter refers to Mr. Shashidhar Shastris June 1, 2021, email in response to the U.S.

Nuclear Regulatory Commissions (NRC) May 6, 2021, letter1. In that letter the NRC provided LGC Global a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of

$22,500 unless the two portable moisture density gauges, each containing 5.5 millicuries of radium-226, and the two x-ray analyzers, one containing a 4.5-millicurie americium-241 sealed source and one containing a 40-millicurie cadmium-109 sealed source, were transferred to authorized recipients by June 6, 2021. The NRCs December 30, 2020 (ML20364A250), and May 6, 2021, letters incorrectly stated that LGC Global possessed two x-ray analyzers. Based on additional information provided by LGC Global including a picture of the x-ray analyzer, the NRC concluded that LGC Global only possessed one analyzer containing both the americium-241 and the cadmium-109 sealed sources.

Mr. Shastris email included, as attachments, documents indicating that the two portable gauges and the material analyzer were properly transferred to authorized recipients. The NRC reviewed Mr. Shastris email with attachments and concluded that LGC Global provided the information requested in the Notice of Violation, and the portable gauges and x-ray analyzer were transferred to authorized recipients prior to June 6, 2021. Based on this information, the NRC will not impose a civil penalty.
