IamcontactingyoutoprovideastatusupdateonthepetitionforrulemakingyousubmittedtotheU.S.Nuclear RegulatoryCommission(NRC),datedMarch14,2011,onbehalfoftheFoundationforResilientSocieties(the Foundation).Inyourpetition,yourequestedthattheNRCamenditsregulationsinTitle10oftheCodeofFederal Regulations(10CFR)Part50toaddressconcernsabouttheeffectsoflongtermcommercialgridoutageonspentfuel poolcoolingandwatermakeup.Youstatedthatintheeventofalongtermlossofcommercialgridpowerextending beyondamonth,itislikelythatwaterinspentfuelpoolswouldheatupandboiloff,fuelrodswouldbecomeuncovered bywater,zirconiumcladdingwouldcatchfire,andlargeamountsofdangerousradionuclideswouldbereleasedintothe atmosphere.

Previously,weinformedyouthattheMitigationofBeyondDesignBasisEvents(MBDBE)finalrule(84FR39684;August 12,2019)addresses,inpart,theissuesthatyouraisedinyourpetition.Specifically,theseregulationsrequirelicensees toestablishoffsiteassistancetosupportmaintenanceofthekeyfunctions(includingbothreactorcoolingandspentfuel poolcooling)followinganextendedlossofalternatingcurrentpower,whichhasbeenpostulatedtobeaconsequence ofgeomagneticdisturbances.WealsoidentifiedthatonMarch26,2019,twoeventsoccurredthatdirectlyaffectthe NRCsanalysesrelatedtoPRM5096.First,theExecutiveOfficeofthePresidentsNationalScienceandTechnology CouncilissuedtheNationalSpaceWeatherStrategyandActionPlan(NSWSAP).Second,thePresidentissued ExecutiveOrder(EO)13865,CoordinatingNationalResiliencetoElectromagneticPulses(84FR12041;March29, 2019).TheNRCsworkrespondingtotheEOandtheNSWSAPisongoing.TheNRCsworkrespondingtotheEOandthe NSWSAPisongoing.ThisworkwillinformhowtheCommissionproceedswithPRM5096.
