SUMMARY
OF MAY 13, 2021, PUBLIC MEETING WITH INDUSTRY OPERATOR LICENSING REPRESENTATIVES On May 13, 2021, the U.S. Nuclear Regulatory Commission (NRC) staff held a public meeting with the Nuclear Energy Institutes (NEI) Licensed Operator Focus Group (LOFG) and other industry operator licensing representatives. The purpose of the meeting was to share the NRC staff's resolution to specific comments received during the 75-day public comment period for draft NUREG-1021, Operator Licensing Examination Standards for Power Reactors, Revision 12, related to Critical Tasks, significant performance deficiencies and critical performance deficiencies.
NRC management opened the meeting and provided an overview of Revision 12, which is the result of a significant effort to accomplish the following: reorganize the entire NUREG to make it easier to use; re-integrate the generic fundamental topics into the site-specific examination and discontinue the stand-alone Generic Fundamentals Examination; establish clear expectations for use of accredited training programs when determining eligibility standards, and thus eliminating the need for the NRC staff to consider waiving facility requirements; and change critical task (CT) development criteria and grading approach to make them more risk-informed; and improve guidance for identifying performance deficiencies (PDs).
Next the NRC staff provided details, including that they received 124 distinct comments from 12 different submitters including industry representatives, facility licensees, a design certification applicant, and NRC staff members. The majority of the recommendations made by the commenters were implemented thus improving the clarity of the instructions and guidance in NUREG-1021.

The NRC staff carefully considered the comments received in opposition of the proposed operating test scenario grading approach and made the following changes to the proposed grading of critical tasks and significant performance deficiencies that was proposed in the draft NUREG for comment:
A critical performance deficiency (CPD) will be restored to a 3-point deduction, however if an applicant has 2 or more CPDs, they will fail the simulator scenario portion of the operating test, regardless of their calculated scores for the competency areas
Restored the ability of an examiner to recommend a failure for an applicant that demonstrated a performance deficiency with serious safety consequences. This was removed from the draft NUREG because it would have been unnecessary with the proposed failure for one CPD
Enhanced the guidance for developing CTs to make it more useable with a focus on what types of tasks meet the critical distinction instead of a focus on applicant actions. For example, Actions that directly lead to the restoration of one or more safety functions
Removed the classifier procedural from the CT guidance so that the focus is on the task and not procedure direction and to make CT identification less prescriptive, especially for post scenario CT determinations
Changed the SPD criteria to plant conditions met for an Alert or a non-fission product barrier Site Area Emergency
Added specific information for what is not a SPD: single channel RPS/ESF actuations and power changes made for conservative decision making
All communications PDs will be treated the same and graded as they are in Revision 11
