SUSPENSION OF REVIEW OF AMENDMENT REQUEST DATED MARCH 15, 2021 FOR NIOWAVE, INC., NRC LICENSE NO. 21-35144-04
Dear Dr. Peters:
We have reviewed your March 15, 2021 request to amend your U.S. Nuclear Regulatory Commission (NRC) License No. 21-35144-04. You have requested to expand your licensed activities including, but not limited to, new uses of radioactive material, changes to the facility and equipment, and additional radioactive material in quantities meeting the criteria set forth in Title 10 of the Code of Federal Regulations (10 CFR) 30.32(i) and 10 CFR part 37. On May 19, 2021, you submitted an emergency plan in accordance with 10 CFR 30.32(i)(1)(ii).
Based on the review, our office determined we need additional time to evaluate certain information to continue the review of your amendment request. Therefore, we administratively suspended this licensing action in the Web-Based Licensing (WBL) system in accordance with our licensing guidance. We will notify you if we need any additional information from you during our evaluation.
In accordance with 10 CFR 2.390 of the NRCs Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the NRCs ADAMS, accessible from the NRC Web site at https://www.nrc.gov/reading-rm/adams.html.
