Onbehalf oftheU.S. Nuclear Regulatory Commission (NRC), Iam responding to your May25,2021, letter supporting theNRC's efforts toaccelerate theestablishment oftherisk-informed, technology-inclusiveregulatory framework for advanced nuclear technologies. Thankyoufor recognizing the considerable workbytheNRCstaff "to ensure that a thoughtful rulemaking isachieved onthe accelerated timeline." Thestaff iscurrently working tocomplete thisrulemaking byOctober 2024, which would besignificantly ahead of theNuclear Energy Innovation andModernization Act(NElMA) deadline ofDecember 2027.
TheCommission understands theimportance ofthiseffort toenable thedevelopment anddeployment ofadvanced nucleartechnologies. TheNRCis developing a predictable, andappropriately framework flexible, toenable amoreefficient licensing process. The framework accommodate will variousadvanced reactor technologies, prioritizing risk-informed andperformance-based licensing approaches toprotect public healthand safety throughout thelife ofa facility.
Asnoted inyour completing letter, this rulemaking onanaccelerated schedule requires substantialeffortsandresources. TheNRCcontinues toengage with andseekinput from numerous stakeholders,including theU.S. Department ofEnergy, trade groups, vendors, developers, nongovernmental organizations, members ofthepublic, Congress, andthe NRC's Advisory Committee onReactor Safeguards onthe development ofthis proposed rule. The Commission submit will a report toCongress byJuly 14,2021, toprovide a detailed account of theNRC's progresstoward establishing this regulatory framework for advanced reactor technologies.
