Iamsubmitting this letter astheNRC'sannual report related totheprotection ofwhistleblowers required bythe "National Defense Authorization ActforFiscal Year 2018" (PublicLaw115-91)

(the Act).

Section 1097(d)(1) oftheActrequires agencies toincorporate theprotection ofwhistleblowers into jobrequirements andperformance standards ofsupervisory employees.

Thereafter, each agency mustreport annually toCongress thenumberofsupervisors whofailed tomeetthese critical standards, thereasons forthedetermination that they failed, andwhatperformance-based orcorrective actions weretaken bytheagency inresponse.

Ican report that theNRChadno confirmed violations oftheActduring ourlast performance cycleof fiscal year2020.

Since thepassage oftheAct,Federal agencies havereceivedfurther direction fromthe Office ofSpecial Counsel (OSC) andtheOffice ofPersonnel Management indicating that joint guidance will beissued foragencies ontheinclusion ofwhistleblower protection criteria in supervisory performance appraisals asrequired bytheAct.OSCrecently provided language that itcurrently usesinitsperformance standards, whichtheNRCisevaluating for incorporation inourperformance standards forfiscal year2022.
