Onbehalf oftheU.S. NuclearRegulatory Commission (NRC), Iam submitting this letterastheNRC's annual report tothe protection related ofwhistleblowers required bythe "National Defense Authorization ActforFiscal Year 2018" (PublicLaw115-91) (the Act).

Section 1097(d)(1)oftheActrequires agencies toincorporate theprotection ofwhistleblowers jobrequirements into andperformance standards ofsupervisory employees. Thereafter, each agency mustreport annually toCongress thenumber ofsupervisors whofailed tomeetthese critical standards, thereasons forthedetermination that they failed, andwhat performance-based orcorrective actions weretaken bytheagency inresponse. Ican report that the NRChadno confirmed oftheActduring violations ourlast performance cycleof fiscal year 2020.

Since thepassage oftheAct, Federal agencies havereceivedfurther direction from the OfficeofSpecial Counsel(OSC) and theOffice of Personnel Management indicating that joint guidance willbeissued for agencies ontheinclusion ofwhistleblower protection criteria in supervisory performanceappraisals asrequired bytheAct. OSCrecently provided language thatitcurrently uses performance inits standards, which theNRCisevaluating for incorporation inourperformance standards for fiscal year 2022.
