Regulatory Requirements For Activities Licensed Under Title 10 Of The Code Of Federal Regulations Section 30.3

Dear Dr. Alt:

This letter is in response to your email dated April 13, 2021. In it you express interest in understanding the regulatory framework regarding certain activities at cyclotron facilities.

You state that ARTMS Inc. does not want to possess, control, or dispose of activated byproduct materials. However, ARTMS Inc. would like for its field technicians to enter radiation-controlled areas and work with activated byproduct materials at a licensed facility. If the ARTMS Inc. field technicians will be performing these stated activities under the licensed facilities radioactive materials license, the NRC does not require that ARTMS Inc. obtain a radioactive materials license in accordance with Title 10 of the Code of Federal Regulations (10 CFR) Section 30.3.

However, if ARTMS Inc. will not be working under the facilities radioactive materials license, then ARTMS Inc. must apply for a license to authorize their work with radioactive materials. In order to apply for a U.S. Nuclear Regulatory Commission (NRC) radioactive materials license, ARTMS Inc. must have a physical location in the United States, in accordance with 10 CFR 110.53(a).

The NRC does not regulate the cyclotrons used to produce byproduct material but does regulate the byproduct material once produced. ARTMS Inc. is responsible for determining any additional regulatory requirements that may be imposed on its proposed activities by a specific state as cyclotrons are licensed under state regulations.
