This LAR proposes toinclude inthelicensed areaall areas which should beunder license.
Italso identifies areas towhich access will be controlled bythelicensee based onthemaximum potential infrastructure that could beinstalled andoperated during anyremediation phase.
Basis fortheCurrent Definition oftheLicensed Area Based onknowledge oftheprocessing, transport, anddisposal activities that occurred during the facility's operating
- years, aswell asinformation obtained during radiological site characterization, in1994theCimarron Site wasdivided into thefollowing three "Phase" areas:
1 "Phase IUnaffected Areas",
defined asareas within which soil orsurface contamination wasnotexpected toexceed background levels.
2."Phase IIAffected andUnaffected Areas",
defined asareas within withsoil orsurface contamination wasexpected toexceed background, butmaynotexceed license criteria.
3."Phase IIIAffected Areas",
defined asareas within which soil orsurface contamination wasknowntoexceed license criteria.
Eachofthese "Phase" areas werefurther divided into Subareas A through O.Theboundaries of theSubareas werebased onthelocations ofbuildings, impoundments,
- roads, andformer burial areas.
Noconsideration wasgiven togroundwater.
Thepresence ofuranium exceeding decommissioning criteria ingroundwater wasnotknownandwastherefore notconsidered inthe delineation ofSubareas.
Thedecommissioning ofbuildings, impoundments,
- roads, andformer burial areas hasbeencompleted, andallbutthree ofthe16former Subareas havebeenreleased fromthelicense, asreflected inSNM-928, Amendment 21.
Theformer Subarea designations arenolonger relevant totheongoing decommissioning ofthe Site.
License SNM-928retains three oftheformer Subareas under

Whenlicense SNM-928 wastransferredtotheCERT,theFebruary 16,2011license transfer order
- stated, "Final status surveys andconfirmatory surveys haveconfirmed that Subareas Gand N arereleasable for unrestricted use,butNRChasdetermined that these areas should notbe released until groundwater remediation iscomplete."
EPMproposes tore-define thelicensed areabased onknowledge of existing conditions andplanned construction andoperations that will support theremediation ofgroundwater.
There isnoreason toretain portions offormer Subareas whichhavebeendemonstratedto be releasable for unrestricted use,andwhich nofuture decommissioning activities will impact.
Consequently, this license amendment request proposes toretain only those portions ofSubareas G andN inwhich decommissioningoperations maybe performed under
- license, asdescribed inthe DP.
M Whenfinal status surveys wereperformed fortheformer
- Subareas, groundwater exceeding the decommissioning criteria wasnotexpected tobepresent except inandaround four disposal trenches located inSubarea F.Site-wide groundwater assessment (conductedafter allSubareas except Subareas F,G,andNhadbeenreleased fromthe license) identified groundwater exceeding thedecommissioning criterion foruranium inportions ofSubareas C,D,E,H,andM.
Thepurpose ofthis LARistobring backunder license those portions ofthesite which hadbeen
- released, butwithin which:
- Groundwater exceeds license criteria.
- Groundwater exceeding license criteria will
- bestored, transferred, ortreated during the groundwater remediation effort.
- Licensed material generated during removal ofuranium from groundwater, which hasnot yetbeenpackaged fortransportation inaccordance with DOTregulations, maybe transferred fromafuture Burial Area#1(BAl) treatment facility totheWestern Area Treatment Facility (WATF).
- Contaminated
- media, such astreatment resins containing concentrated
- uranium, will be stored and/or packaged forshipment fordisposal.
Thislicense amendment request proposes toretain only those portions ofSubareas GandN in which decommissioning operations will beperformed under license.
Suchanamendment would release mostofSubareas GandNfromthelicense, retaining only those portions ofSubareas G
andN subject totheabove-stated conditions.
Subarea G
Subarea Gwasa"Phase II"areacontaining bothaffected andunaffected areas.
Theaffected areas included theSite road overwhichlicensed material hadbeentransported, thesurface water drainage channel eastofUranium Pond#1,andanareacontaining concrete rubble fromthe Page2of9

MostofSubarea Gwasconsidered unaffected byformer site operations andwastedisposal activities.
Release surveydata forconcrete slabs placed inSubarea Gwasreported inaletter dated September 16, 1998. A report onanNRCconfirmatory survey oftheconcrete during a
September 1998 inspection concluded that thereleased concrete slabs comply withlicense criteria.
After performing afinal status survey fortheroad,
- drainage, andland
- areas, Final Status Survey
- Report, Subarea G(ML20043F258) wassubmitted totheNRConOctober 21, 1999.TheNRCperformedaconfirmatory survey forSubarea GinAugust 2001.The inspection included the collection and analysis ofgroundwater forbothuranium andTc-99.
The November 26,2001NRCinspection report 70-925/01-01 concluded that Subarea Gland and groundwater complies with license criteria.
Inaletter dated March12,2002, theNRCstated, "U.S. Nuclear Regulatory Com.mission (NRC) staff hasidentified regulatory issues concerning therelease ofSubareas
- GandK, related totheoccurrence oftechnetium-99 (Tc-99) in Subarea G,andaneedforan approved decommissioning schedule inyour license. In response, NRCstaff hasdecided to withhold release ofSubarea Guntil Cimarron addresses theonsite Tc-99 contamination."
Subsequent assessment ofTc-99ingroundwater demonstrated that Tc-99 concentrations were well below theNRCcriterion forgroundwater, andtheNRCapproved thediscontinuation of monitoring forTc-99 inaletter dated April 22,2013(ML20171A868).
Consequently, the "onsite Tc-99contamination" hasbeenaddressed fromalicense compliance perspective.
Subarea N
Subarea Nwasa"Phase III" area.Subarea N included Burial Area#4.Burial Area
- 4 contains soil that complies withLicense Condition 23ofSNM-928, described asOption 2material inthe 1981Branch Technical Position Disposal orOnsite Storage ofResidual Thorium orUranium (Either asNatural OresorWithout Daughters Present)
FromPastOperations (ML19363A009).
Subarea N also included thesite road onwhichOption 2soil wastransported from stockpiles located neartheformer process buildings toBurial Area#4.
After Burial Area#4wasclosed incompliance withLicense Condition 23,afinal status survey wasconducted forSubarea N.Final Status Survey Report for Subarea N(ML20043F229) was submitted totheNRConJanuary 31,2002.TheNRCperformed aconfirmatory survey for Subarea N inJune2002.Theinspection included thecollection andanalysis ofgroundwater for bothuranium andTc-99.
TheSeptember 18,2002NRCinspection report 70-925/02-01 concluded that Subarea N land andgroundwater complies withlicense criteria.
Subarea F
Subarea Fwasa"Phase III" area.

Final status survey reports weresubmitted for:
- Theexcavated burialtrenches, inDecontamination andFinal Survey Report for CimarronFacility Contaminated Waste Burial Ground(MLl9363A014).
- Theconcreterubble, inFinal Status Survey Report for Concrete Rubble inSub-Area F
(ML20043F213).
- Soil, inFinal Status Survey Report,Sub-Area F(ML20043F208).
TheNRChasperformed confirmatory surveys fortheformal burial trenches andtheconcrete rubble inSubarea Fandcollected confirmatory soil samples fromsoil borings in2013.The confirmatory survey process hasbeencompleted forbothsurface andsubsurface soil.
Because uranium exceeds thedecommissioning criterion ingroundwater, EPMproposes herein toretain theentirety ofSubarea Funder license.
Definition ofLicensed andControlled Areas Based ontheabove considerations, this LARproposes to include inLicense Condition 9of License SNM-928,"Authorized Place ofUse"those areas within which:
- Groundwater exceeds license criteria.
- Groundwater exceeding license criteria will
- bestored, transferred, ortreated during the groundwater remediation effort.
- Ifduring thesecond phase ofgroundwater remediation, aseparate ion exchange systemis installed inBurial Area#1(BA1),
licensed material which hasnotyet been packaged for transportation inaccordance with DOTregulations maybetransferred from aBA1 treatment facility totheWestern AreaTreatment Facility (WATF).
- Contaminated
- media, such astreatment resins containing concentrated
- uranium, willbe stored and/or packaged forshipment fordisposal.
- AllofSubarea F.
Attachment 1tothis license amendment request provides four figures depicting theproposed areatobeincluded inLicense Condition 9.These figures depict theproposed "licensed" area and"controlled" areas.
Licensed material cannot beaccessed throughout mostofthelicensed
- area, because throughout thedecommissioning ofthesite itwill bepresent only ingroundwater orinunderground piping.
Reddashed lines onFigures 1through 4depict theextent ofthe proposed licensed area.Thelicensed areawill bedelineated onsite bythefollowing:
1.Monitor wells.
2.Cairns installed atthelocations offormer monitor wells that havebeenabandoned orat other "corners" 3.A corridor extending perpendicularly 5metersfromthecenterline ofthesite road.
4.Fencing around controlled areaswill define aportion ofthelicensed area(after construction ofwatertreatment infrastructure iscomplete).

1.Groundwater containing licensed material isbrought above ground tobetreated.
2.Groundwater istreated to remove uraniumandTc-99 inionexchange systems.
3.Treatment mediais processed, packaged, andstored prior toshipment toalicensed disposal facility.
Figure 1depicts theproposed licensed andcontrolled areas inthewestern portion oftheSite.
A black isopleth depicts theareawithin which uranium concentrations exceed 100micrograms per liter (pg/L).
TheU-235enrichment inthis area
- varies, and100pg/Lisalower concentration than would yield atotal uranium activity of180picoCuries perliter (pCi/L) atthehighest conservatively estimated enrichment.
Consequently, the black line representsagreater areathan that within which groundwater contains exceeds the decommissioning criteria.
Thereddashed line extends beyond this
- area, providing additional "buffer"around theareawithin which groundwater exceeds thedecommissioning criteria.
Thelicensed areaalso includes theareawithin which piping will transport groundwater exceeding thedecommissioning criteria.
AllPhase Iinfrastructure isdepicted inorangelines; Phase Iinfrastructure includes all piping which maytransmit groundwaterexceeding the decommissioning criteria aswell as"clean" treated waterthat will beinjected,such asin Subarea M. Finally, theroadway overwhich vessels ofspent resin maylater betransported from BA1totheWATF(potentially during Phase IIremediation) isincluded inthe licensed area.

During Phase I,remediation infrastructure will consist ofaninfluent
- tank, a
pumping
- station, andequipment toinject treated water into injection trenches.Allthis will belocated within thecontrolled areashown onFigure2.
- Groundwater maybetreated (during PhaseII) toremove uranium from the groundwater byionexchange within thecontrolled area.
IfPhase IIincludes treatment foruranium inBAl,vessels containing spent resin will be removed fromBA1andtransported totheWATFforprocessing, packaging, storage and shipment.
Wastewill notbestored orstaged within BAl,except forincidental consumables suchasgloves,
- filters, etc.,
that will bestored inawastereceptacle prior totransfer tothe WATF;such wastewill betransferred totheWATFattheendofeachday.

theCERTofficeis currently locatedoutside ofthelicensed site andwill continue tobeoutside ofthelicensed area until theWestern AreaTreatment Facility (WATF) isconstructed several years fromnow.Licensed material andradioactive sources arestored intheCERToffice; until theWATFisconstructed,some provision forthereceipt andstorage ofradioactive material in theCERToffice isneeded.
EPMproposes that the "Authorized Place ofUse"inLicense Condition 9beamended tothat portion ofthelicensee's property depicted onFigure3ofthis LAR,aswell asprovide for temporary receipt andstorageof materials at thestreetaddress oftheCERToffice, which is100 Highway
- 74North, Guthrie, OK 73044.
License Condition 23andtheRelease ofSubareaN License Condition 23provides authorization toburyup to 14,000 cubic meters(500,000 cubic feet) ofsoil contaminated withlow-enriched uranium containing upto100picoCuries pergram (pCi/g) forsoluble uranium andupto250pCi/g for insoluble uranium intheareanowreferred to asBurial Area#4(BA4).
BA4islocated inSubarea N.
BTPOption 2On-Site Disposal Cell Report (ML20043F202) provides adescription ofthe characterization, placement, andcovering ofcontaminated soil inBA4.

- uranium, andcovered inBA4.
Pit#1contains 164,518 cubic feet(ft3)
OfSOil Containing anaVerageuranium activity of45.0 pCi/g.
Pit#2contains 155,950 ft3 OfSOil Containing anaverage uranium activity of43.3 pCi/g.
Pit#3contains 131,718 ft3 OfSoil containing anaverage uranium activity of35.7 pCi/g. The total volume ofcontaminated soil inBA4istherefore 452,185 ft3 OfSOil Containing anaVerage uranium activity of41.7pCi/g.
Thetotal activity ofuranium inthesoil placed inBA4is 0.989 Curies.
Uponcompleting theplacement ofcontaminated
- soil, eachofthetrenches wascovered with aminimum of4feet ofsoil andvegetation wasestablished overthesoil cover.
License Condition 23(a)
- states, "Thelicensee shall periodically monitor thedisposal areafor subsidence,
- erosion, andstatus ofthevegetative coverforatleast
- 5years, andpromptly repair anyproblems noted."
Thedisposal areawasmonitored forwell over5years, andeven18years after thecover wasplaced andvegetated, there isnoevidence ofsubsidence orerosion.
The vegetative coverremains effective, covering 100%oftheareawithadense stand ofgrass.
License Condition 23(b)
- states, "Notification shall beplaced onthelandtitle todeclare that uranium-contaminated soil hasbeenburied onthesite andtorecord thevolume, average uranium concentration, andexactlocation oftheburied soil.
