Solely asTrustee for theCimarronEnvironmental Response Trust (CERT), Environmental Properties Management LLC(EPM) subm.its herein tothe USNuclear Regulatory Commission (NRC) this request toamend License SNM-928 tore-define the area under license. This license amendment request (LAR) supersedes theN ovember 22, 2 019 L AR to reflect the r e-definition of the licensed area based onthe two-phase remediation approach presented in theFebruary 26, 2021 Facility Decommissioning PlanRev2 (theDP ML21076A479).
TheDP explains the phasedapproach indetail. This LAR proposes toinclude inthe licensed area allareas which shouldbeunder license. Italso identifies areas towhich access will be controlled bythe licensee basedonthe maximum potential infrastructure thatcould beinstalled andoperated during anyremediation phase.
Basis for the Current Definition ofthe Licensed Area Based onknowledge oftheprocessing, transport, anddisposal activities that occurred during the facility'soperating years,aswellasinformation obtained during radiological site characterization, in1994 theCimarron Sitewasdivided into the following three "Phase" areas:
1 "Phase IUnaffected Areas",defined asareas within which soil orsurface contamination wasnotexpected toexceed background levels.
- 2. "Phase IIAffected and Unaffected Areas", defined asareas within with soil orsurface contamination wasexpected toexceed background, but maynotexceed license criteria.
3."Phase IIIAffected Areas",defined asareas within which soil orsurface contamination wasknown toexceed license criteria.
Each ofthese "Phase" areaswerefurther divided into Subareas A through O.Theboundaries of the Subareas were based onthe locations ofbuildings, impoundments, roads, andformer burial areas. No consideration wasgiven togroundwater. Thepresence ofuranium exceeding decommissioning criteriaingroundwater wasnotknown and wastherefore notconsidered inthe delineation ofSubareas. Thedecommissioning ofbuildings, impoundments, roads, andformer burialareas has been completed,andall but three ofthe16former Subareas have been released from the license, asreflected inSNM-928, Amendment 21.
Theformer Subarea designations arenolonger relevant tothe ongoing decommissioning ofthe Site. License SNM-928 retains three ofthe former Subareas under license, twoofwhich P400 Parkway Word Oty,

Whenlicense SNM-928 wastransferred tothe CERT,the February 16,2011 license transfer order stated,"Final status surveys and confirmatory surveys have confirmed that Subareas G and N are releasable for unrestricted use,but NRChasdetermined that these areas should notbe released until groundwater remediation iscomplete." EPMproposes tore-define the licensed area based onknowledge of existing conditions and planned construction andoperations thatwill support the remediation ofgroundwater. There isnoreason toretain portions offormer Subareas which have been demonstrated to be releasable for unrestricted use, andwhich nofuture decommissioning activities will impact. Consequently, this license amendment request proposes toretain only those portions ofSubareas G andN inwhich decommissioning operations maybe performed under license, asdescribed inthe DP.
M Whenfinal status surveys were performed for theformer Subareas, groundwater exceeding the decommissioning criteria wasnotexpected tobepresent except in andaround four disposal trenches located inSubarea F.Site-wide groundwater assessment (conducted after all Subareas except Subareas F, G, and N had been released from the license) identified groundwater exceeding the decommissioning criterion for uranium inportions ofSubareas C,D,E,H,andM.
Thepurpose ofthis LARis tobring back under licensethose portions ofthe site which hadbeen released, but within which:
- Groundwater exceeds license criteria.
- Groundwater exceeding license criteriawillbestored, transferred, ortreated during the groundwater remediation effort.
- Licensed material generated during removal ofuranium from groundwater, which hasnot yet been packaged for transportation inaccordance with DOTregulations, maybe transferred from afuture Burial Area #1(BAl) treatment facility tothe Western Area Treatment Facility (WATF).
- Contaminated media, such astreatment resinscontaining concentrated uranium, will be stored and/or packaged for shipment for disposal.
This license amendment request proposes toretainonly those portions ofSubareas G andN in which decommissioning operations will beperformed under license. Such anamendment would release mostofSubareas G and N from t hel retaining icense, only those portions ofSubareas G andN subject tothe above-stated conditions.
Subarea G Subarea Gwasa"Phase II" area containing both affected andunaffected areas. Theaffected areas included the Site road over which licensed material hadbeen transported, the surface water drainage channel east ofUranium Pond #1, andanarea containing concreterubble from the Page 2 of9

Release surveydata forconcrete slabs placed inSubarea Gwasreported inaletter dated September 16, 1998. A report onanNRCconfirmatory surveyofthe concrete during a September 1998 inspection concluded that the released concreteslabs comply with license criteria.After performing a final status survey for the road, drainage, andland areas, Final Status Survey Report, Subarea G (ML20043F258) was submitted tothe N RC on October 21, 1999. TheNRCperformedaconfirmatory survey for SubareaG inAugust 2001. The inspection included the collection and analysis ofgroundwater forboth uranium andTc-99. The November 26, 2001 NRCinspection report 70-925/01-01 concluded thatSubarea G land and groundwater complies with licensecriteria.
Ina letter dated March 12, 2002, the NRCstated, "U.S. Nuclear Regulatory Com.mission (NRC) staff has identified regulatory issues concerning therelease ofSubareas G andK, related tothe occurrence oftechnetium-99 (Tc-99) in Subarea G,and aneed for an approved decommissioning schedule in your license. response, NRCstaff In has decided to withhold release ofSubarea G until Cimarron addresses the onsiteTc-99 contamination."
Subsequent assessment ofTc-99 ingroundwater demonstrated that Tc-99 concentrations were well below the NRCcriterion for groundwater, andthe NRCapproved the discontinuation of monitoring for Tc-99 inaletter dated April 22, 2013 (ML20171A868). Consequently, the "onsite Tc-99 contamination" has been addressed from alicensecompliance perspective.
Subarea N Subarea N wasa"Phase III" area. Subarea N included BurialArea #4.Burial Area #4 contains soil thatcomplies with License Condition 23of SNM-928, described asOption 2material inthe 1981 Branch Technical Position Disposal orOnsite Storage of Residual Thorium orUranium (Either as Natural Ores o r Without Daughters Present) From Past O perations (ML19363A009).
Subarea N also included the siteroad onwhich Option wastransported 2 soil from stockpiles located near the former process buildings toBurial Area #4.
After Burial Area #4wasclosed incompliance with License Condition 23, afinal status survey wasconducted for Subarea N.Final Status Survey Report forSubarea N(ML20043F229) was submitted tothe NRConJanuary 31,2002. TheNRCperformed a confirmatory survey for Subarea N inJune 2002. Theinspection included the collectionandanalysis ofgroundwater for both uranium andTc-99. TheSeptember 18, 2002 NRCinspection report 70-925/02-01 concluded that Subarea N land andgroundwater complies with license criteria.
Subarea F Subarea F wasa"Phase III" area. Subarea F included trenchesinwhich licensed material had been buried (then referred to as Burial Ground #1) and slabs of concrete removed from t he Page 3of9

- Theexcavated burialtrenches, inDecontamination andFinal Survey Report for CimarronFacility Contaminated Waste Burial Ground (MLl9363A014).
- Theconcreterubble, inFinal Status Survey Report for Concrete Rubble inSub-Area F (ML20043F213).
- Soil, inFinal Status Survey Report,Sub-Area F (ML20043F208).
TheNRChas performed confirmatory surveys for the formal burial trenches andthe concrete rubble inSubarea F andcollected confirmatory soilsamples from soil borings in2013. The confirmatory survey process has b een completed forb oth surface and subsurface soil.Because uranium exceeds the decommissioning criterion ingroundwater, EPMproposes herein toretain the entirety ofSubarea F under license.
Definition ofLicensed andControlled Areas Based onthe above considerations, this LARproposes to include inLicense Condition 9of License SNM-928, "Authorized Place ofUse" thoseareas within which:
- Groundwater exceeds license criteria.
- Groundwater exceeding license criteria willbestored, transferred, ortreated duringthe groundwater remediation effort.
- Ifduring the second phase ofgroundwater remediation, aseparate ion exchange system is installed inBurial Area #1(BA1), licensed material which has notyet been packaged for transportation inaccordance with DOTregulations maybetransferred from aBA1 treatment facilitytothe Western Area Treatment Facility (WATF).
- Contaminated media, such astreatment resinscontaining concentrated uranium, willbe stored and/or packaged for shipment for disposal.
- All ofSubarea F. tothis license amendment request provides four figures depictingthe proposed area tobeincluded inLicense Condition 9.These figures depict the proposed "licensed"area and"controlled" areas. Licensed material cannot beaccessed throughout mostofthe licensed area, because throughout the decommissioning ofthe site itwill bepresent only ingroundwater orinunderground piping. Reddashed lines onFigures 1through 4 depict the extent ofthe proposed licensed area. Thelicensed area will bedelineated onsite bythe following:
1.Monitor wells.
2.Cairns installed atthe locations offormer monitor wells that have been abandoned orat other "corners" 3.A corridor extending perpendicularly 5meters from the centerline ofthe siteroad.
4.Fencing around controlled areas will define aportion ofthe licensed area(after construction ofwater treatment infrastructure iscomplete).

Access tocontrolled areas will becontrolled byafence andlocking gates, except where the exterior walls ofthe WATF buildingprovide access control. Controlled areas are depicted by solid green lines, and include those areas towhich access needs tobecontrolled because:
1.Groundwater containing licensed material isbrought above ground tobetreated.
2.Groundwater istreated to remove uranium andTc-99 inion exchange systems.
3.Treatment media isprocessed, packaged, andstored prior toshipment toalicensed disposal facility.
Figure 1depicts theproposed licensed andcontrolled areas inthe western portion ofthe Site. A black isopleth depicts the area within which uranium concentrations exceed 100micrograms per liter (pg/L). TheU-235 enrichment inthis area varies, and100 pg/L is a lower concentration than would yield atotal uranium activity of180picoCuries per liter (pCi/L) atthe highest conservatively estimated enrichment. Consequently, the black line representsa greater area than that within which groundwater contains exceeds the decommissioning criteria. Thered dashed line extends beyond this area, providing additional "buffer" around the area within which groundwater exceeds the decommissioning criteria.
Thelicensed area also includes the area within which piping will transport groundwater exceeding the decommissioning criteria. AllPhase Iinfrastructure isdepicted inorangelines; Phase Iinfrastructure includes all piping which maytransmit groundwater exceeding the decommissioning criteria aswell as"clean" treated water that will beinjected, such asin Subarea M. Finally, the roadway overwhich vessels ofspent resin maylater betransported from BA1tothe WATF(potentially during Phase IIremediation) isincluded inthe licensed area.
Thearea bounded bythe solid green line represents the controlled area, andincludes allareas within which:
- Groundwater containing uranium exceeding the decommissioning criteria isbrought to the surface.
- Groundwater istreated toremove theuranium byion exchange.
- Spent ion exchange resin isprocessed andpackaged for shipment toalicensed disposal facility.
- Waste that contains concentrations ofradioactive material requiring disposal aslowlevel radioactive waste is tored orstaged.
Figure 2 depicts theproposed licensed andcontrolled areas inthe eastern portion ofthe Site. A black isopleth depicts the area within which uranium concentrations exceed 201pg/L. The conservative estimate ofthe U-235 enrichment inthis area is1.3%, and201pg/L isthe Page 5of9

Consequently, theblack line represents the maximum potential extent ofgroundwater containing uranium exceeding the decommissioning criteria. Thered dashed line extends beyond this area, providing additional "buffer" around the area within which groundwater contains uranium exceeding the decommissioning criteria.
Thearea within the reddashed line also includes the area inwhich piping will transport groundwater in which uranium exceeds the decommissioning criteria, including thatwhich will transport groundwater totheWATF. All Phase Iinfrastructure isdepicted inorange lines.
Phase Iinfrastructure includes all piping whichmaytransmit groundwater exceeding the decommissioning criteria aswell as"clean" treatedwater thatwill beinjected. Finally, if groundwater istreated toremove the uranium byion exchange inBA1,the treatment area and the roadway over which vessels ofspentresin may betransportedfrom BA1tothe WATFare included inthe licensed area. Asexplainedon Page 4 above, the licensed areas will include all offormer Subarea F.
Thearea within the solid green line isthe controlledarea, andincludesall areas within which:
- Groundwater containing uranium exceeding the decommissioning criteria isbrought to the surface. During Phase I,remediation infrastructure will consist ofaninfluent tank,a pumping andequipment station, toinject treated water into injection trenches.All this will belocated within the controlled areashown onFigure2.
- Groundwater maybetreated (during Phase II) toremove uranium from the groundwater byion exchange within the controlled area.
IfPhase IIincludes treatment for uranium inBAl,vessels containing spent resin will be removed from BA1andtransported tothe WATFfor processing, packaging, storage and shipment. Waste w illnot be stored or staged within BAl, except for i ncidental consumables such asgloves, filters,etc., thatwill bestored inawaste receptacle prior totransfer tothe WATF;such waste will betransferred tothe WATFatthe endofeach day.
This figure depicts theproposed licensed andcontrolled areasthroughout the Site, including the entire extent ofthe Site road between BA1 andthe WATF.
Cross-hatching provided inFigure 3identifies those portions ofSubareas G andN that would be licensed under License SNM-928 should the licensebeamended inaccordance with this request.
Thetable onFigure 3provides the acreage that would beunder license ineach former Subarea.
M A survey ofpotential cultural orhistoric resources wasperformed in2019. Results were reported inthe September 9,2020 report, Phase ICultural Resources Survey of the Cimarron Environmental Response Trust Property (ML20253A33). Figure 4 shows the r elationship between the proposed licensed andcontrolled areas,the maximum area that could bedisturbed Page 6of9

Decommissioning construction andoperations will have noimpact onany potentialhistoric resources.
the CERToffice is currently located outside ofthe licensed site andwill continue tobeoutside ofthe licensed area until the Western Area Treatment Facility (WATF) isconstructed several years from now.Licensed material and radioactive sources arestored inthe CERToffice; until the WATFis constructed,some provision for thereceiptstorage and of radioactive material in the CERToffice isneeded.
EPMproposes that the "Authorized Place of Use"inLicense Condition 9beamended tothat portion of t he l icensee's property depicted on Figure 3 of t his LAR, as well as provide for temporary receipt andstorage of materials at thestreet address of the CERToffice, which is100 Highway 74North, Guthrie, OK 73044.
License Condition 23andthe Release ofSubareaN License Condition 23provides authorization toburyup to 14,000 cubic meters (500,000 cubic feet)of soil contaminated with low-enriched uranium containing up to 100 picoCuries per gram (pCi/g) for soluble uranium andupto250pCi/g for insoluble uranium in the a rea now referred to asBurial Area #4(BA4). BA4islocated inSubarea N.
BTPOption 2On-Site Disposal CellReport (ML20043F202) provides adescription ofthe characterization, placement, andcovering ofcontaminated soil inBA4. Three trenches, labeled "Pit #1","Pit #2", and"Pit #3"wereexcavated, backfilled with soil containing less than 100 pCi/g uranium, andcovered inBA4.
Pit#1contains 164,518 cubic feet(ft3) OfSOil Containing anaVerage uranium activity of 45.0 pCi/g. Pit contains ft3
- 2 155,950 OfSOil Containing anaverage uranium activity of43.3 pCi/g.
Pit#3contains 131,718 ft3OfSoilcontaining anaverage uranium activity of35.7 pCi/g. The totalvolume ofcontaminated soilinBA4istherefore 452,185 ft3 OfSOil Containing anaVerage uranium activity of41.7 pCi/g.Thetotal activityofuranium inthe soil placed inBA4 is0.989 Curies. Uponcompleting theplacement ofcontaminated soil, each ofthe trenches wascovered with aminimum of4feet ofsoilandvegetation wasestablished over the soil cover.
License Condition 23(a) "The states, licensee shallperiodically monitor the disposal area for subsidence, erosion, andstatus ofthe vegetative cover for atleast 5years, andpromptly repair anyproblems noted." Thedisposal area wasmonitored for well over 5years, andeven18years afterthe cover wasplaced andvegetated, thereisnoevidence ofsubsidence orerosion. The vegetative cover remains effective, covering 100%ofthe area with adense stand ofgrass.
License Condition 23(b) "Notification states, shall beplaced onthe land title todeclare that uranium-contaminated soilhas been buried onthe site andtorecord the volume, average uranium concentration, andexact location ofthe buried soil. This notification isnottobe Page 7of9

Caims, consisting of concrete cylinders with brass plates,surrounded bysteel bollards, were placed atthe fourcorners ofBA4.Thebrass discs wereengraved with the coordinates ofthe corners, the words "Radioactive Disposal Area", andlines indicating the boundaries ofBA4.
Thelocation ofBA4,the total volume ofsoil, andthe total activity ofuranium (rather than the uranium average concentration) was recorded on the property deed f iled with the County Recorder onSeptember 19, 2002. Attachment 3tothis license amendment request includes a copy o fthe n otification that was placed inthe d eed a ndapicture of thec airn that was installed at the southeast corner ofBA4.
Asdescribed above, allwork authorizedby or required byLicense Condition 23has been completed. TheNRC'sstatement that thenotification inthe deed "isnottobeconsidered a restriction onthe sale orfuture useofthe site"further supports EPM's recommendation forthe unrestricted release ofthis portion ofSubarea N.
License Condition 25released Subareas A through E forunrestricted use. License Condition 28 released Subareas JandO for unrestricteduse. License Condition 29released for unrestricted useSubareas H,I,L,andM. License Condition 30released Subarea K for unrestricted use. For allofthese Subareas, the NRCstated inthose four license conditions, "It is nolonger licensed by NRC."
Ifthe NRCapproves the re-designation ofthe licensed area asproposed herein. these four license conditions should bedeleted. Portions ofseveral ofthese former Subareas will be re-incorporated into the licensed site,andportions will remain released forunrestricted use. The former Subarea designations nolonger serve anypurpose andshould nolonger bereferenced to define licensed portions ofthe site orareas that are nolonger licensed bythe NRC.EPM requests that License Conditions 25,28,29,and30bedeleted from License SNM-928.
