OF THE MARCH 8, 2021, SECOND PUBLIC MEETING WITH THE DAIRYLAND POWER COOPERATIVE REGARDING PROPOSED CHANGES TO THE EMERGENCY PLAN FOR THE LA CROSSE BOILING WATER REACTOR INDEPENDENT SPENT FUEL STORAGE INSTALLATION

Background

On March 8, 2021, a secondary Category 1 public meeting was held between U.S. Nuclear Regulatory Commission (NRC) staff and representatives of the Dairyland Power Cooperative (DPC, the licensee) via teleconference.

The purpose of the meeting was to discuss proposed changes to the La Crosse Boiling Water Reactor (LACBWR) Emergency Plan that will take place once the decommissioning activities are complete at the site and the license for the remaining independent spent fuel storage installation (ISFSI) structures is fully returned from EnergySolutions, LLC, to DPC. This meeting was specifically held to discuss additional proposed changes to the LACBWR ISFSI Emergency Plan made after the original public meeting on this topic took place on January 25, 2021.

Meeting

On March 8, 2021, the NRC staff held a second public meeting with DPC to allow the licensee and the staff to discuss proposed changes to the LACBWR ISFSI Emergency Plan (E-Plan) before the application is submitted to the NRC. Some of the proposed changes represent reductions in commitment that will require NRC approval prior to implementing, so the meeting was an opportunity for the staff to provide feedback before the submittal is finalized.

DPC kicked off the technical portion of the meeting by discussing the changes to the proposed E-Plan that were implemented after the January 25, 2021, public meeting on the same topic.

Specifically, the DPC staff noted that the revised proposal no longer considers exemptions from the emergency planning requirements found in 10 CFR 50.47(b)(12), 10 CFR Part 50, Appendix E, Section IV.B.1, and 10 CFR Part 50, Appendix E, Section IV.E. DPC also noted that formal submittal of the proposed E-Plan to the NRC is expected by April 2021.

DPC noted that the revised E-Plan will propose an alternate process for meeting the regulations in lieu of seeking an exemption from any of the emergency planning requirements. Specifically, the licensee will maintain the contaminated individual requirements and discussion in the E-Plan but will work with the local hospital under a memorandum of understanding (MOU) to perform drills and training as required under the associated NRC regulations. The NRC staff noted that if the licensee elects to use this approach, the appropriate level of detail still needs included in the proposed E-Plan to address the regulatory requirement and cautioned that any missed actions by the local hospital or offsite agency would be the responsibility of the licensee (i.e.,

enforcement actions would be against DPC and not the local hospital or other organizations).

The licensee is also proposing to have radiation monitoring during an accident conducted by an outside method (HAZMAT teams, virtual technical support, etc.). The NRC staff noted there are concerns with this approach as radiation monitoring is the licensees overall responsibility and suggested that having a strong MOU and/or agreement with other nuclear facilities would be advisable if proceeding with this proposed approach. Regardless, the NRC staff noted that an appropriate level of explanation and detail will be needed in the proposed E-Plan.

Finally, DPC discussed that changes to their emergency action level (EAL) scheme would be made consistent with the discussion in the proposed E-Plan and based on a calculation of accident scenario doses. Based on this discussion, the NRC staff believes that this approach would align with the current LACBWR technical specifications, and that the EAL limits are based on reasonable assumptions and judgements. The NRC staff provided feedback on each of these items to assist the licensee in developing its E-Plan changes and subsequent submittal for review and engaged in discussion with the DPC staff to ensure that any questions or concerns were understood and addressed.
