Rhoades (Exelon Generation Company, LLC) - "Three Mile Island Nuclear Station, Units 1 and 2 - Approval of Exemptions from the Requirements of 10 CFR 140.11(a)(4), Concerning Offsite Primary and Secondary Liability Insurance (EPID L-2020-LLE-0002)," dated March 9, 2021 (ML21040A258)

On March 9, 2021, the U.S. Nuclear Regulatory Commission (NRC) approved the exemption from specific requirements of 10 CFR 140.11(a)(4) concerning offsite primary and secondary liability insurance for Three Mile Island Nuclear Station, Units 1 and 2 (TMI). This action requested an exemption to reduce the required level of primary offsite liability insurance from

$450 million to $100 million and to eliminate the requirement to carry secondary financial protection for TMI. The exemption is effective approximately 16 months (488 days) after the after the permanent shutdown of TMI, Unit 1 (TMI-1). On September 20, 2019, the TMI-1 reactor was permanently shut down. Enclosure 2 of Reference 1 was Amendment No. 17 to Indemnity Agreement No. B-37.

As part of the implementation of this exemption, a signed Amendment No. 16 to Indemnity Agreement No. B-64 for TMI needs to be docketed. Attached to this letter is the signed Amendment.

No commitments to the NRC are made in this letter.
