DUANE ARNOLD ENERGY CENTER - EXEMPTION FROM THE REQUIREMENTS OF 10 CFR 140.11(a)(4) CONCERNING OFFSITE PRIMARY AND SECONDARY LIABILITY INSURANCE AND AMENDMENT NO. 15 TO INDEMNITY AGREEMENT NO. B-68 (EPID L-2020-LLE-0115)
Dear Mr. Moul:
The U.S. Nuclear Regulatory Commission (NRC) has approved the enclosed exemption from the requirements of Title 10 of the Code of Federal Regulations (10 CFR) Section 140.11(a)(4) concerning offsite primary and secondary liability insurance for NextEra Energy Duane Arnold, LLC (NEDA).
This action is in response to the application dated July 16, 2020, requesting an exemption to reduce the required level of primary offsite liability insurance from $450 million to $100 million and to eliminate the requirement to carry secondary financial protection for the Duane Arnold Energy Center (DAEC). The exemption is effective as of 10 months after permanent cessation of power operations for DAEC, which is June 10, 2021. A copy of the exemption is provided in to this letter.
to this letter contains two signed copies of Amendment No. 15 to Indemnity Agreement No. B-68 for NEDAs signature. We request that you sign the two originals and then return one of the signed originals to the NRCs Document Control Desk as proof of acceptance.
Please keep the other signed original for your records.
In accordance with 10 CFR 2.390, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs Agencywide Documents Access and Management System (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
The exemption has been forwarded to the Office of the Federal Register for publication.

Docket Nos. 70-1384 50-331 AMENDMENT TO INDEMNITY AGREEMENT NO. B-68 AMENDMENT NO. 15 Effective June 10, 2021, Indemnity Agreement No. B-68 between NextEra Energy Duane Arnold, LLC, and the United States Nuclear Regulatory Commission, dated May 15, 1973, as amended, is hereby further amended as follows:
Article VIII of the Indemnity Agreement is deleted in its entirety wherever it appears in the Indemnity Agreement, and is substituted therein by the requirements of the exemption permitting a reduction in primary financial protection from $450,000,000 to $100,000,000, and withdrawal from participation in the secondary layer of financial protection.
Item 2a of the Attachment to the Indemnity Agreement is deleted in its entirety and the following substituted therefor:

A historical licensee name change to the original indemnity agreement and attachments thereof was not previously recorded. Therefore, the following name change is listed here as a matter of record:
On April 16, 2009, FPL Energy Duane Arnold, LLC was renamed NextEra Energy Duane Arnold, LLC. This change was administrative in nature and did not involve a license transfer.
