Dear Richard Arnold and Ron Johnson:

This letter is in reference to the petition for rulemaking (PRM-37-2) that you submitted on behalf of the Tribal Radioactive Materials Transportation Committee to the U.S. Nuclear Regulatory Commission (NRC) on December 4, 2020 (NRCs Agencywide Documents Access and Management System (ADAMS) Accession No. ML21042B011). As stated in the NRCs February 16, 2021, letter (ADAMS Accession No. ML21047A358), the NRC docketed this petition under Section 2.803 of Title 10 of the Code of Federal Regulations (10 CFR), Petition for Rulemaking-NRC Action. In the petition, you request that the NRC revise its regulations in 10 CFR Part 37, Physical Protection of Category 1 and Category 2 Quantities of Radioactive Material, to ensure consistency with 10 CFR Part 71, Packaging and Transportation of Radioactive Material, and 10 CFR Part 73, Physical Protection of Plants and Materials, regarding advance Tribal notification of certain radioactive material shipments.

The enclosed notice of docketing of the petition will be published in the Federal Register. The NRC is requesting public comment on your PRM. As the staff reviews your petition, it may be necessary to request additional information.
