On February 17, 2021, NRC staff held a conference call with American Centrifuge Operating (ACO) to discuss the following proposed license condition:
Within 30 days of making any non-administrative changes to the validation report, the Licensee shall provide the Commission with a summary of changes and shall provide the revised validation report upon request. The licensee may not implement changes to reduce the Minimum Margin of Subcriticality (as defined in LA-3605-0001 Appendix F) without NRC approval of the change.
The NRC staff asked ACO staff to explain why the proposed license condition indicated Minimum Margin of Subcriticality as opposed to the term used in 10 CFR 70.61(d), which is the margin of subcriticality for safety. ACO staff indicated that they would revisit the referenced regulation and determine if a change to the proposed license condition is needed. The participants of the call were as follows:
