U.S. NUCLEAR REGULATORY COMMISSION RELAXATION OF CONDITIONS IN THE CONFIRMATORY ORDER

Dear Col. Naeem:

The U.S. Nuclear Regulatory Commission (NRC) acknowledges receipt of your email dated February 1, 2021 (Agencywide Document Access and Management System (ADAMS)

Accession Number ML21034A574), providing an update to commitments in the November 19, 2020, Confirmatory Order (CO) (ADAMS Accession Number ML20303A211). The NRC has decided to relax the following commitments due to the timing of planned training course completion.

Condition B.2.h.ii of the CO states, in part: The Program Officer shall complete specific training addressing topics such as intake of allegations/safety concerns and trending of concerns (e.g.,

National Association of Employee Concerns Professionals (NAECPs) Employee Concerns Program basics course, or similar training). This training shall be completed within 180 days of designation as the Program Officer.

Your email stated that the next available NAECP ECP basics course is not scheduled until September 2021. According to the commitment within the CO, the Program Officer is required to complete the training within 180 days of their designation; therefore, the training is required by May 2021. You requested that the NRC relax Condition B.2.h., allowing the Program Officer to complete the training in September 2021. I approve of this modification to the CO commitment to allow the completion of the course in September 2021. However, if this course is postponed or cancelled, I expect you to communicate to the NRC your plans to schedule attendance to a comparable class offered by another organization.

In accordance with Title 10 of the Code of Federal Regulations (10 CFR), Section 2.390, of the NRC's Rules of Practice, a copy of this letter and your response (if any) will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of the NRCs Agencywide Document Access and Management System (ADAMS). ADAMS is accessible from the NRCs website at http://www.nrc.gov/reading-rm/adams.html (the Pubic Electronic Reading Room).
