ADVANCE NOTICE OF PROPOSED RULEMAKING -

CATEGORICAL EXCLUSIONS FROM ENVIRONMENTAL REVIEW (RIN 3150-AK54; NRC-2018-0300)

Your approval and signature are requested on the enclosed Federal Register notice for an Advance Notice of Proposed Rulemaking (ANPR). In Staff Requirements Memorandum (SRM)-SECY-20-0065, Rulemaking Plan-Categorical Exclusions from Environmental Review, dated November 30, 2020 (Agencywide Documents Access and Management System Accession No. ML20336A009), the Commission approved the staffs recommendation to initiate a rulemaking to add new categorical exclusions and amend existing categorical exclusions in Part 51 of Title 10 of the Code of Federal Regulations, Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions. The Commission also approved the staffs recommendation to delegate authority for issuing the ANPR to the Executive Director for Operations.

Staff has developed the ANPR to request public input on specific topics and ask questions on possible revisions to the U.S. Nuclear Regulatory Commissions (NRC) requirements for categorical exclusions from environmental review. Stakeholder input will be used to inform the development of the proposed rule. In developing the ANPR, the staff used targeted internal communications to identify examples of possible changes related to categorical exclusions in accordance with direction from SRM-SECY-20-0065. For example, staff launched a challenge campaign through the IdeaScale platform from February 16 to March 2, 2021, to seek input from NRC staff to help identify amendments, clarifications, or new category of actions for inclusion in the ANPR. Staff publicized this campaign through agencywide announcements, the intranet home page banner, newsletters, and targeted e-mails. Staff also met with licensing project management staff who regularly apply the categorical exclusions to identify other potential categorical exclusion changes. In addition, as requested in SRM-SECY-20-0065, staff briefed the Commissioners Assistants on the ANPR contents on April 5, 2021.
