I just confirmed with Victoria Huckabay, the rulemaking project manager, that the 13 publications listed are correct and includes all documents we plan to incorporate by reference in the 2019-2020 Code Editions proposed rule (including the NQA-1 documents).
One item of note, however: at the time the list was compiled, the 2020 Edition of the OM Code had not yet been published, and is listed as not issued, as of the date of this request. It has since been issued, the publication date is June 30, 2020.

Upon review of the correction below against the original request attached, I realized that the text of the original email did not request access to the NQA publications. However, the attachment included with the 3/31/20 request lists a total of 13 publications for access to during the rulemaking public comment period, including the three NQA publications cited below:
- 2011 Addenda to NQA-1-2008, Quality Assurance Requirements for Nuclear Facility Applications (NQA-1b-2011),
- 2012 Edition of NQA-1, Quality Assurance Requirements for Nuclear Facility Applications, and
- 2015 Edition of NQA-1, Quality Assurance Requirements for Nuclear Facility Applications.
In order to provide the correct access, please confirm that the attached list of 13 publications is correct and complete. Thank you again for the opportunity to support the rulemaking process, I look forward to your reply.

By e-mail to Mr. Christian A. Sanna dated March 31, 2020, the Nuclear Regulatory Commission (NRC) requested that the American Society of Mechanical Engineers (ASME) provide limited public access to certain standards which are to be incorporated by reference into Section 50.55a, Codes and standards, of Title 10 of the Code of Federal Regulations (CFR). Included in that request were Sections III and XI of the 2019 Edition of the Boiler and Pressure Vessel (BPV) Code and 2020 Edition of the Operation and Maintenance (OM) Code, which the NRC asked to be made available for the comment period of the proposed rule that would seek to incorporate by reference those standards. We found that our previous request was incomplete.
With this e-mail, the NRC is amending the original request, consistent with the scope of the proposed rule and the intent to incorporate ASME standards in 10 CFR 50.55a. In addition to the previously requested 2019 Edition of BPV Code and 2020 Edition of the OM Code, the NRC is requesting that ASME provide members of the general public with read-only access to the following documents:
2011 Addenda to NQA-1-2008, Quality Assurance Requirements for Nuclear Facility Applications (NQA-1b-2011),
2012 Edition of NQA-1, Quality Assurance Requirements for Nuclear Facility Applications, and 2015 Edition of NQA-1, Quality Assurance Requirements for Nuclear Facility Applications.
The NRC is asking that these documents be made available for the duration of the 60-day comment period of the proposed rule, which is estimated to begin on or about March 4, 2021. Please note that the publication schedule is subject to change and adjustment. No later than 30 calendar days prior to the planned publication date, the NRC rulemaking staff will contact you with an update on the schedule and to make final arrangements. If you have any questions about the publication schedule, the NRC rulemaking project manager, Victoria Huckabay, can be reached at Victoria.Huckabay@nrc.gov.
The NRC is not asking your organization to waive its intellectual property rights to these materials, nor does the NRC seek to undermine or impair your organizations business model with respect to the development and publication of the BPV and OM Codes and NQA-1 standard. The NRC recognizes the value of your organization's efforts to develop and update these standards. Reliance on these standards substantially reduces the amount of resources and time it would otherwise take for the NRC to address design, inspection, and repair of systems, structures, and components in nuclear power plants.
ASMEs fulfillment of this request will help the NRC satisfy the Office of the Federal Register requirements in 1 CFR Part 51 regarding agency requests for approval to incorporate by reference into the CFR materials already published elsewhere.
