UNITED STATES NUCLEAR REGULATORY COMMISSION CHARTER FOR THE LICENSING SUPPORT NETWORK ADVISORY REVIEW PANEL

1. Committee's Official Designation (Title):

Licensing Support Network Advisory Review Panel (LSNARP)

2. Authority:

In accordance with the Federal Advisory Committee Act (5 U.S.C. App) , an advisory committee designated as the LSNARP is established by the Nuclear Regulatory Commission (NRG) pursuant to 42 U.S.C. § 2201 (a) and 10 CFR § 2.1011 (d).

3. Objectives and Scope of Activities:

The NRC's Rules of Practice in 10 CFR Part 2, Subpart J, establish the basic procedures for the submission and management of records and documents relating to the licensing of a geologic repository for the disposal of high-level radioactive waste (HLW) . The procedures include the use of an electronic discovery information management system known as the Licensing Support Network (LSN).

The primary purpose of the LSNARP is to evaluate technical issues relating to the operation and maintenance of the LSN and perform continuing assessments to determine if the LSN is performing its intended function and serving users' needs.

The LSNARP shall provide advice to:

a. The Secretary of the Commission on the operation and maintenance of the electronic docket established for the HLW geologic repository licensing proceeding ; and
b. The LSN Administrator on solutions to improve the functioning of the LSN .
4. Description of Duties:

When requested in accordance with this charter, the LSNARP may provide advice on :

a. The format standards for providing electronic access to the documentary material certified by each participant to be made available in the LSN to the other parties and interested governmental participants to the HLW licensing proceeding adjudication ;
b. Procedures and standards for the electronic transmission of filings , orders, and decisions during the HLW licensing proceeding; and
c. Other duties as specified in 10 CFR Part 2 or as directed by the Secretary of the Commission or the Chief Administrative Judge, Atomic Safety and Licensing Board Panel (ASLBP).

7. Estimated Annual Operating Costs and Staff Years:

Future estimated costs are dependent on the location of any LSNARP meeting and whether "virtual" meeting technology is used. For example, a 2-day "virtual" meeting of the LSNARP would cost approximately $60,000 (including 0.3 FTE). Future costs are also dependent on whether one or more LSNARP technical working groups are formed.

8. Designated Federal Officer:

A full-time Federal employee will serve as the Designated Federal Officer (DFO). The DFO will approve or call all of the full LSNARP and subcommittee meetings, prepare and approve all meeting agendas, attend all LSNARP and subcommittee meetings, chair meetings when directed to do so by the ASLBP's Chief Administrative Judge, and adjourn any LSNARP and subcommittee meeting when the DFO determines adjournment to be in the public interest.

9. Estimated Number of Meetings per Year:

During periods of routine activity, the LSNARP would be expected to meet approximately one to two times a year and may utilize telephonic or web-based video- and audio-conferencing capabilities.

10. Duration:

The LSNARP is a continuing committee that meets as necessary for the duration of the HLW proceeding .

11. Termination:

The LSNARP will terminate 2 years from the charter filing date (see Section 15) unless renewed sooner by appropriate action.

12. Membership and Designation:

Membership includes representatives of parties or governmental entities with an interest in the HLW repository licensing proceeding adjudication . This includes representatives of the State of Nevada, the Department of Energy, the NRC, the affected units of local government in Nevada and California , the National Congress of American Indians, the Nevada Nuclear Waste Task Force, and a coalition of industry groups. Selected Federal agencies with substantial experience in electronic information management systems may also be included on the LSNARP. Consistent with the Federal Advisory Committee Act, the Secretary of the Commission may appoint additional representatives, giving particular consideration to those who acquire party or interested governmental participant status in the HLW licensing proceeding adjudication .

13. Subcommittees:

The LSNARP (with approval of the DFO) may create subcommittees that report to the full LSNARP. All work prepared by subcommittees is reviewed and approved by the full LSNARP.

14. Recordkeeping:

All records of the LSNARP and any subcommittees shall be handled in accordance with National Archives and Records Administration (General Records Schedule 6.2) and NRC requirements and shall be available to the public for inspection and copying ,

subject to the Freedom of Information Act, 5 U.S:C. § 552.
