OF DECEMBER 17, 2020, CATEGORY 2 PUBLIC WORKSHOP ON SPENT FUEL PERFORMANCE MARGINS On December 17, 2020, the U.S. Nuclear Regulatory Commission (NRC) held a Category 2 remote public workshop with the Nuclear Energy Institute (NEI) and other industry representatives to continue dialogue on recommendations contained in the NEIs white paper on Spent Fuel Performance Margins dated November 8, 2019 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML19318D971). This workshop built upon previous held meetings and workshops including those conducted on January 22, 2020 (ADAMS Accession No. ML20028F277), March 25-26, 2020 (ADAMS Accession No. ML20106F135), April 15-16, 2020 (ADAMS Accession No. ML20126G388), June 11, 2020 (ADAMS Accession No. ML20170A355), June 23, 2020 (ADAMS Accession No. ML20197A299), and July 28, 2020 (ADAMS Accession No. ML20223A352), September 9, 2020 (ADAMS Accession No. ML20262H259), and November 6, 2020 (ADAMS Accession No. ML20329A468) respectively. This was the 9th workshop with NEI on the white paper recommendations.

The December 17, 2020, workshop, the NRC staff, the NEI, and industry representatives focused the discussions on a process walk-through related to spent fuel storage application review risk tool, and implementation of the Graded Approach for spent fuel license applications. In particular, the NRC staff gave a presentation on the graded approach to certificates of compliance (CoC) of storage systems. The next presentation topic given by the NRC staff was on spent fuel storage job aid risk informing reviews tool. During this discussion, the NRC staff discussed in detail, what the risk tool is and what it does, along with the description of activities that the NRC Risk Tool Working Group is currently undertaking.

Specifically, the following discussion materials were used by the NRC staff to facilitate the subject workshop:

2 The industry representatives, from TN Americas, discussed the industrys considerations on the implementation associated with Graded Approach Pilot. The industry then provided its perspective on adopting the new graded approach in CoC of storage systems, identified its assessed benefits and challenges. The following discussion materials were used by the industry during the subject workshop:

As a result of the above discussions, expected outcomes were achieved including stakeholder feedback on the topics discussed, continuous refinement of project plans, and identification of next steps for enhancing spent fuel storage licensing. The NRC staff summarized the outcomes resulted from the December 17, 2020, workshop and shared the next milestones and future workshops being planned.

At the end of the workshop, the NRC staff provided an opportunity for the members of the public to comment or ask questions regarding NRCs regulatory process related to the topics discussed. A member of the public had a number of questions related to the risk tool and use of Probabilistic Risk Assessment in storage systems, including issues related to spent fuel canister drop. The NRC staff addressed these questions during the meeting, with the exception of one question which would require follow up. The NRC staff indicated that the respective response would be provided in the meeting summary associated with the December 17, 2020, workshop.

With this summary, the NRC staff notes that the specific question related to the 11-inch spent fuel canister drop was previously addressed via another NRC forum with members of the public, and the respective NRC response is available under ADAMS Accession No. ML20353A397.

More than 40 individuals from industry, vendor groups, public citizens, and NRC staff attended the workshop (some participating in portions only) via WebEx and telephone bridge line. The discussions held during this workshop benefited both the NRC staff and industry representatives, as they provided an effective and efficient forum of communication for all parties involved. No NRC staff decision was made during the meeting.

CATEGORY 2 PUBLIC WORKSHOP ON SPENT FUEL PERFORMANCE MARGINS December 17, 2020 On December 17, 2020, the U.S. Nuclear Regulatory Commission (NRC) held a Category 2 remote public workshop with the Nuclear Energy Institute (NEI) and other industry representatives to continue dialogue on recommendations contained in the NEIs white paper on Spent Fuel Performance Margins dated November 8, 2019 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML19318D971). The December 17, 2020, workshop, the NRC staff, the NEI, and industry representatives focused the discussions on a process walk-through related to spent fuel storage application review risk tool, and implementation of the Graded Approach for spent fuel license applications.

After the opening remarks by the NRC and the NEI, the NRC staff gave a presentation on the graded approach to certificates of compliance (CoC) of storage systems. In this presentation, the NRC staff provided background information related to the historical challenges on the CoC of storage systems and proposed graded approach as a solution. The NRC staff amplified by discussing a pilot for graded approach along with detailed elements on how to go about for implementation. The next presentation topic given by the NRC staff was on spent fuel storage job aid risk informing reviews tool. During this discussion, the NRC staff discussed in detail, what the risk tool is and what it does, along with the description of activities that the NRC Risk Tool Working Group is currently undertaking. The NRC staff also provided specific examples on applying risk took in the areas of materials, shielding, and structural considerations.

The industry representatives, from TN Americas, discussed the industrys considerations on the implementation associated with Graded Approach Pilot. The discussions highlighted the six basic results expected from the Graded Approach Pilot and outlined the reasons for implementation, and the associated potential challenges, respectively. The industry then provided its perspective on adopting the new graded approach in CoC of storage systems, identified its assessed benefits and challenges.
