Dear Mr. Berka,

This email is in response to your question about the timeline for a determination on a petition. The timeline for resolving a petition for rulemaking largely depends on the nature and complexity of the request. Generally, it takes 1-2 years for NRC to resolve a legal/technical petition; this estimate is subject to resource availability and other agency priorities.

With respect to your specific petition, the comment period closed October 9, 2019 and a related public meeting on Potential Regulatory Frameworks for Power Reactors was held by NRC staff on February 25, 2020. The NRC staff is reviewing the merits of the petition and the public comments and input that we have received. The staff is preparing a formal recommendation to the Commission for approval. This step can take roughly 8-12 months, plus additional time for the Commission to issue a decision. The Commission makes the final decision on the NRCs actions on petitions for rulemaking. You will continue to receive periodic status updates on your petition every six months.
